I have a hire purchase agreement with GE money.

The other day, a payment was stopped by my bank (because i had put the funds in on that day, and apparently they have to be put in the day before).

GE charged me £45! for the privilege to re-request the direct debit (made up from £30 standard fee and £15 administration costs).

It has happened once before, in July 2006 (same charges). I wrote to them requesting that they refund me as the fees were not akin to their actual costs, and they replied that i had signed an agreement etc so their fees are justified.

Can I request a refund based on Unfair Terms in Consumer Contracts Regulations (as per Martins letter to the banks)?

Has anyone else been sucessful in getting back fees on a hire purchase agreement?

    Thanks

    Congratulations on your success!

Just a quick question as I'm a new comer to this site. When you sent your letter to the bank did you send it to your local branch or their head office complaints department?
  • Filed against Barclays with MCOL on 26th June, so should be deemed as having been served on the 1st July. Still have had no reply from them.

Heres hoping that they don't drop a last min on-line defence over the weekend.
I am going to ask for judgment by default on Sunday (15th)

    Good Luck all
  • i phoned the bank and they told me to send all letters to my branch, oh sent them recorded delivery the first letter i sent did'nt get there or so they said. which delayed things a bit. from then on i sent all letters by recorded delivery so they have no excuse

Thank you for that! I would have sent them via normal post and we all know what can happen to that!

Requested charges back from Abbey, got the usual bank is right not paying you a penny letter

Instructed MCOL to claim money and Abbey submitted a defence

After getting the court date I contacted abbey by phone and gave them one last chance to settle......and they did :j

    Clamed £2545.00 (charges+interest+court fee)
    Received £2139.22

Thanks to Martin :money: and everyone who posted on here! sometimes I felt in over my head, but I kept cool  and finished the game!

I will now go on to help my friends fight the good fight! ;)

Hi just a quick note to say a big thank you !!!!! to Martin and all you guys and girls out there for your help and information. I went through the process of trying to reclaim my charges from Abbey. Having followed the guidance and written to them using the letter templates on site and then subsequently taking Abbey to online court, I have been awaiting my court date in July. When this very morning much to my delight I recieved a letter 'without prejudice' from the Abbey settling my claim in full £4186.50. I am now just waiting for the cheque.

For all of you going through the process yourselves, take heart. Power to the consumer !!!!!!

    All the best Rod:T
