    Postal strike starts at 7pm, so there may still be collections at tea time, but Royal mail recommend not posting today or tomorrow.

    i need help please got a letter from the court stating that i could be struck out unless further particulars need to be served. PLEASE HELP

    A bit of advice please guys.

    I applied for a stack of charges from Halifax on behalf of my brother and finally received a payment of £2800 (100% of charges) and £340.96 (court fee and interest) back on the 7th of June. The letter we received said that they would not admit liablity but the payment was a goodwill gesture and asked us to contact the court to confirm settlement and they would do the same.

    I submitted details on the MCOL site as to the settlement amount received but input the incorrect figure by 1p! meaning the claim now has a rejected status.

    My question is, in between the initiation of the court case and settlement, my brother incurred another £190 in charges. I have submitted the 2 letters to Halifax with no response. I am about to submit another MCOL claim but is this the right course of action and will the previous settlement/mistake on MCOL jeopradise the claim?

  • you seem to be at the same point as myself with the Yorks Bank and I too am wondering if I will end up in court as they have just contested my court request. I'm now wondering what my next step should be

    I found dealing with credit card companies comparatively easy, but that was earlier in the year, reading press reports and this forum it does seem to be
    getting more difficult with the attitude of the Banks/Credit Card companies.
    From experience Barclaycard are possibly the worse, they will make a derisory
    offer to settle, CC action is necessary, they defend but they have paid out
    around three weeks before a Court appearance. But at least you get correspondence from them. Lloyds are absolute sods, both bank and credit cards, they are possibly the rudest most ignorant bunch you could wish to deal with, they just ignore your correspondence as do their Solicitors SCAM.

    Basically it is just perseverence and patience that will beat them in the end,
    just follow the process from this site and victory will be yours.

    Phone them and ask for your claim to be re-evaluated...

    I have just called the Halifax. NO JOY! The man said that there was a note on the system saying they had recieved my letter with the threat of court action. I explained to him as you had said that as the 14days was now up I would no longer accept the lower amount and if I did not recieve the payment in the next 7 days I would start court proceedings.
    The man at HALIFAX advised me not too do that and that it would be in my best interest to contact the financial ombesman? WHY?

    I wait in vain for a response to them now!

    Amanda, the "man" from the Halifax seems to think you are either stupid or a walk over. YOU ARE NEITHER OK ... YES, you could go to OMB, it's free and it will generally take a lot longer. You ask WHY ???? Think about it, the OMB (at least not at the moment) will not force the Halifax to explain it's charges whereas a court can. Halifax like all the banks are scared stiff of the courts because on any day, at any time, a court could ask them for a full breakdown of their charges ..... AS YOU SHOULD BE DOING NOW

    Just let the Halifax know that you are taking the court route because you want to know how they calculate their charges. This will wake up the Halifax and show them you are a serious person. Stick yo your guns Amanda, it is after all the Halifax who took your money AND YOU WANT IT BACK IN FULL

    Thank you for your advise. Do you think I should call them again in the morning and just tell them that I am actually taking the court route.
    This whole process is becoming very stressful.
    I wrote my first letter in March, I had to wait over 60days for my bank charges list to be sent out it just seems to be one thing after another.
    I want to also claim from Nationwide and Woolwich but I dont know if I can handle any more long winded process'.
