I didnt think that it was worth contacting them to argue the point as you mentioned. I did send them an offer letter "without Prejudice" of course, offering to settle for a reduced amount stating they must replay in 14 days, but the 14 days have passed with no response!

Andy, I think twinkly is right, they will use any terminology to throw you off track. They turning up in court is very remote over the amount, you should push forward with your claim

So should i try to contact them about the offer or just send a letter saying i am taking court action?

Tell them that if your claim is not met in full, you will commence legal proceedings. Do it by Recorded Delivery letter

Hello there, so far I have managed to get back £860 from Halifax and £3080 from RBS - both claims were straightforward after a bit of stalling and posturing from them in the initial stages (no mcol on either claim) so I am pleased so far.

Now I want to go after Alliance and Leicester credit card, Egg card and co operative card for charges gioing back two or three years... Please can I ask - are people having the same kind of success with the card companies? I understand it is the same procedure we follow (and thanks to this wonderful site for making it so easy for us) Any one have knowledge of these particular cards and whether they are paying up or making it hard work.

I had to stand my ground with the Halifax but they rolled over pretty easy really to be honest - RBS just dealt with it all in their own time (8weeks without any contact with me whatsoever during the process so I can't say they gave me any grief at all other than the wait. WillI find it so easy with the credit card charges?

Thanks in advance for any advice offered and keep going to all of you who are still waiting your result - if it can happen for me it can happen for anyone (cos I have absolutely no luck with money usually! )
    cheers and good luck, Ella

I sent the Halifax a letter 15 days ago telling them how much I was claiming for which is the threat letter for court action if no reply within 14 days, and guess what? It is now day 15 and I am yet to recieve a reply from them. Can someone please advise if I should call them or write to them with the threat of court action.
    Thanks

You should phone them and say the 14 days have expired and if the refund is not forthcoming within the next 7 days, you will commence legal proceedings against them without further notice to themselves.

Remember as of 5pm tonight (12/07/07) there is a 24 hour postal strike that will disrupt everything for a few days
