Hi, hope someone can help me - I am at the part where you take the bank to court, so went on line and filled in the form, however this is where the problem is, the bank is the Royal Bank of Scotland and England and Scotland have different laws regarding this, so couldnt carry on. Also read up on the scottish bit and it says you can only claim 5 years charges and a maximum of £750??? Can anyone tell me what to do. I have worked it out and I am owed £1082 without interest so not far out with the 750 but need to know the next step. Many thanks in advance!! Debbie
If you live in England, you apply English law regardless if they are called the Royal Bank of Scotland. NATWEST is owned by the RBS but both have branches nationwideThe Winner Takes it All0 -
Hi, I need some help PLEASE!
I wrote to Halifax on the 21st June with the threat letter asking for 70% of my money back as I had recieved the letter from them saying they had investigated my case and that there was nothing they was going to do.
It has now been just over 14 working days and I am a bit confused as to what I do know.
Can someone please help me?

The 14 days have now expired for Halifax. Advise them you will issue a summons and ask the question, "how do you calculate your charges"The Winner Takes it All0 -
I have got as far as taking Lloyds to court. They are defending the claim and I have been given a court date. Just wondering if i need to go to the court on the date or what I have to do as i've not got a clue.
If you want to win, YES you must go to court. Chances are that Lloyds will not be present so you will win by defaultThe Winner Takes it All0 -

He got the first letter telling him to phone the bank on Thursday, and the settlement offer came on Friday. We had to send and sign back by this Friday but obviously we did that immediately. Don't think the money has gone in yet...0 -

Just to let you know, agreed full settlement with Barclays on Thursday. Money went into account on Tuesday morning, as promised.
Now going to ring and ask for the additional £702 they've taken since commencing court action to be returned! If not, I'm off again. I was quite shocked when I added up how much they have taken since March - over £700. Daylight robbery!!

As they have refunded you, the £702 must be refunded as well as it is accrued penalty charges before the refund.

hi,
does anyone have any advice they can offfer, i applied for my bank statements they did not arrive, reapplied and finally they arrived. The bank then ignored my first two letters so i started court proceedings against the natwest for £1715 including court fee.
GUESS what i have today discovered that they have submitted a defence, am waiting for the next stage. getting very fraustrated and fed up this has been going on for the best part of three months (that was when i initally requested the bank statements).
first the natwest sent me only 2 months worth, then when i re-requested they told me i had to pay a further £10, when i finally argued that with them i received them.
what happens next, they have filed a defence?0 -
Halifax haven't replied to my request for a copy of charges within the 40 days as i stated in my letter.
Whats my next step?0
