  • Halifax haven't replied to my request for a copy of charges within the 40 days as i stated in my letter.
    Whats my next step?

    Report them to the Information Commissioner, should get things moved along for you :)

    PLEASE I NEED URGENT HELP

    Story so far

    On the 24th of April I worte to the bank requesting they pay my bank charges.<O:p</O:p
    (This was before I saw this site!)<O:p</O:p
    I waited and then on the 20/06/2007 I sent them the 2nd letter from this site giving them 14 days to pay up. <O:p</O:p
    <O:p</O:p
    Problems:<O:p</O:p
    1. I didnt have a full list of my bank charges,

    2.However I have been advised on over the phone on more than one occasion that it amount up to just over £1900!

    Now however
    I have received an update from the lace credit card people.<O:p* I got an offer of £500 which I have refused.<O:p</O:p
    * I escalated the situation further to no avail<O:p></O:p>
    * I have finally got hold of my bank statments. It actually totals up to £1462 and an intrest of about £258 bringing it all to a grand total of £1720.<O:p></O:p>
    *I called them today again to say if they do not have an offer for me I am taking it to court but id prefer to settle directly with them. Their response was in the region of f*** off & just wait.<O:p></O:p>
    *Now although the original letter was claiming for £1900 its been way more than 8 weeks. Can I take them to court. If so for how much as I dunno whether to file for £1720 (actual amount incl intrest) OR for £1900 which is what i was told over the phone originally!?<O:p</O:p
    Please help as I would like to sort this out ASAP!<O:p

    P.s 1. I have also included cash advance charges of £2 which I have £25.60 worht of. Is that allowed


    Ps.2 . On the interest calculator my intrest came to £258. But the amount of intrest I ahve paid on that card up till today is £1026.84. Is this allowed?<O:p></O:p>

  • I have filed a claim through MCOL and have now received the Court Allocation Questionnaire i have followed the guidelines for filling this in. Do i need to send the draft order for directions or can i just send copies of my correspondence to the bank with a copy of spreadsheet showing bank charges and interest calculations back with the questionnaire.

    As all the banks behave in a different way, which is the bank you refer to

    You cannot claim cash advance charges, only the penalty charges

    You claim for the amount that you can prove in court as believe me the bank will check your claim.
    Please help as I would like to sort this out ASAP!<o>:p</o>

    Unless you can prove that the interest charged is purely on bank charges you can't claim that. Please read the Reclaim Help Thread, linked in my signature as to what you can and can't claim.
  • hey got through to abbey on phone today and they actually spoke to me
    they say i should receive an offer of £80 in post this week i am claiming £1798 inc int so told them no deal told it will take up to 8 weeks to go through next stage does anyone out there know if this is the begining of me winning

    The bank is Halifax and its an halifax credit card!

    SHould I take it to court first thng tomorrow?

    Have received court date and request for the additional £100 as allocation questionnaire has been dispensed with.

    The Notice of Allocation indicates that we must deliver to every other part and to the court copies of all documentation - this is the court bundle I believe. It then goes onto say that we mustfile with the court and the other party a signed witness statement, no problem, except that it says that it must not be a bundle of relevant documents then further down it says that you should attach any relevant documentation - which is right, and also is there any set format for a witness statement, does anyone have a link, or shall I do what the letter says and imagine I am writing a letter to a friend.

    Have just found out that Halifax intend to defend the claim. I never telephoned them I just sent letters.

    Is it too late to ring them??

    I'm scared about going to court, can anyone advise me please?

    Tiddly just go with the flow, its a normal thing now for banks to do, you,ve gone this far you may aswell carry on...wait till you see what defence they put in, you will receive this soon from the court.
