    Looking back to the various posts, it is worth while understanding why banks defend .....

    They are sent the summons from the court isssued by you. They must reply with something and it certainly will not be "admitting the charges are unlawful"

    The only option they have is to send in a defence. Even when they do this, there is no intention of appearing in court, they are simply adhering to our legal system.

    There is currently NO DEFENCE that they can offer with regards to the charges and no bank is going to tender to the court how they calculate these penalty charges.

    If they did not send in a defence it could be deemed they are guilty.

    So, when the court tells you the bank have defended, it actually means very little as the chances of them attending is very remote especially in view of what happened in Hull, which means they are scared that any judge, from anywhere in the country could select them to provide the answers we all want to hear.

    It is a "Catch 22" situation for all banks, they applied these charges, but they will not tell us how they arrive at them. They have "CHECK MATED THEMSELVES"

    The banks however will continue to act in this manner as it is the only course open to them. We all just have to play the game with them knowing that we will win sooner or later

  • Hiya, wonder if someone can help. my dh is claming his charges back (in body, i'm doing all the hard work!) and on 15th May was sent a letter confirming the court date of 6th Aug 2007. we have received nothing since then either from the court or Natwest and wonder if there is anything we need to do before hand, (it says to bring the original documents with us) or if we just need to go to court on the 6th Aug? any help would be gratefully apreciated:undecided

Seems to be the case, going by some other posts I have read, regarding dates etc. How have you found the FO? I have found that they are very helpful and pleasant to talk to.     Didn't realise the FO sent their mail out in batches! Yes, I have found them to be very helpful and friendly too, hopefully, we shall have our money soon!! God, I'm having nightmares that I'll be the 1st to be turned down!

    Trace, why would you be turned down. If your bank cannot give you a full breakdown on the charges, you will win. Remember also Martin's fighting fund which is waiting for your nightmare.

    Relax, If you have charges that are unlawful, you'll get them back

  • HI ALL CAN ANYONE PUT ME IN THE PICTURE BECAUSE I HAVE READ THS SITE AND NOT COME ACROSS THIS BEFORE WE HAVE GONE THROUGH ALL THE TEMPLATE LETTERS IN TAKING NATIONWIDE TO COURT FOR OUR CHARGES OF £289.94 AND THEY ARE SAYING TO NORTHAMPTON COURT THEY HAVE PUT £155.29 INTO OUR ACCOUNT ON THE 7/7/2007 NO SUCH MONEY AS GONE INTO OUR ACCOUNT IT HAS NOW BEEN REFFERRED TO STAFFORD COUNTY COURT AS THIS IS NEAR TO US CAN ANY ONE HELP ME WHAT TO DO NEXT I MUST SAY I HAVE RANG THE COURT AND EXPLAINED THIS BUT NOT FORM TO FILL IN OR NOTHING I AM NOT GETTING WORRIED AS IT IS GETTING CLOSE TO THE END NOW PLEASE SEND ME PRIVATE MESSAGE AS I SEEM TO LOOSE THE LINKS I AM LOOKING EVERYWHERE TO FIND HELP THANKS DIANE:confused:

    Am I right in thinking your claim was going to Gloucester Court. I was just wondering what your particulars of claim was and whether
    you had received a court date, bacause I had my claim stayed with Glouceter court until the 4th September.:rolleyes: :rolleyes:

    Trace, normally in county court the max is £5000.
