    So its been a while since my last post. In fact it was in Part one of the thread.
    I had to change a few things with my original claim as i put the worng name for the defendant etc. Got that sorted and received a letter from the court today:

    Upon the courts own motion. The court has made this order of its own initiative without a hearing.
    It is ordered that:
    1. The defence is struck out
    2. Unless the defendant files and served a fully pleaded defence in respect of this claim by the 20th july the claimant will be at liberty to enter a judgement.

    Lets hope HSBC arent on the ball.

    I originally calculated the interest for each charge using the calculator on this site. Unfortunately, when putting together the breakdown of charges and interest for my court bundle weeks later, I could not find the original list of values, and as the calculator on this site claculates interest up to today's date, I had to work it all out manually myself, hence the discrepancy. Worried now that this difference in amount to the claim filed can be used against me in court?

    Any help is much appreciated

    Comments: they objected to paying interest. Fair enough since it was an interest free overdraft, so I never did in the first place :rolleyes:. Was going to claim court costs from them too, but in the end decided to take the money and run:beer:
    Good choice on taking the money and running. Sticking it out to banks is always really tough...>_<

    Don't get too worried about it yet. They'll almost certainly settle beforehand anyway. I won against Nationwide who said they couldn't pay coz it wouldn't be fair to other customers, so I gathered success stories showing they did pay out! There was also loads of suggested stuff on this site. You've got loads of time so don't worry.
  • i have got 2 lists of bank charges of the halifax both with diffrent figures on each. the have offered me £347...500 as good will offers and as they owe me £752 i have declined both offers. i have give them 14 days or court action.i got a letter today saying that is the final offer but in there terms.i believe i can go for a undosclosed figure of upto £5000 but how do i do this can you help ....tonyrod911

    Whats the point of a 14 day deadline, if the bank can acknowledge in 15 days. I filed for a judgement yesterday, and today it was rejected after barclaycard filed a late acknowledgement.

    Apparentley a late defence takes precedence over a correctly timed judgement.

    I Sent Of S.a.r 28th February , Then 1st Letter 21/03/2003 , Sent L.b.a Of 05/04/2007 , Filed Mcol And Recieved Notice Of Acknowledgment Then Intent To Defend With 9 Point Defence , Sent Request To Solicitors To Settle Before Court Not Got Date Yet , Received Letter This Morning Full Settlements Plus Interest And Costs , I Am Such A Happy Bunny !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
    Hi, I was wondering how long it took for LLoyds to pay you the money after you recieved your letter from it's solicitors? Thanks x

    I've been going through the motions of claiming back 1,345 pounds on behalf of my girlfriend, and finally had an offer of 1,020 pounds from Barclays.
    I can't get her to haggle, so she signed the acceptance, and sent it back.
    That was 5 weeks ago - any comments on this?
    Has anyone had a similar experience?
    Do they pay up eventually, or are they playing silly games with us?

    Filed against Barclays with MCOL on 26th June, so should be deemed as having been served on the 1st July. Still have had no reply from them.

    Heres hoping that they don't drop a last min on-line defence over the weekend.
    I am going to ask for judgment by default on Sunday (15th)

    cAN YOU TELL WHAT YOU DID AS i AM WAITING FOR A REPLY FROM BARCLAYS THEY WERE SERVED ON THE 5TH JULY AND I THEY HAD TO REPLY BY 21ST 4 DAYS AND COUNTING TO RECIEVE SOMETHING IN THE POST TRIED RINGING BARCLAYS TO SEE WHAT WAS HAPPENING BUT THEY DID NOT WANT TO KNOW
