The saga goes on between Barclays and ourselves. :o<O:p</O:p
<O:p</O:p
Can anyone tell me why is Barclays treating us differently than anyone else on this site? Are they creating a test case or just plain stupid? We will continue to ask the important question “How does Barclays Bank calculate their charges and that I require a full and complete breakdown of their unfair charges over the last six years”.
<O:p</O:p
<O:p</O:p
This morning we have received a FINAL NOTICE for our son on the "ADDITIONS" on his account. The letter goes:

“You have failed to comply with the repayment requests of Central Debt Collection Services, acting on our behalf. As a consequence we are preparing papers which will instigate legal proceedings against you through the County Courts.<O:p</O:p
<O:p</O:p

If payment of the full outstanding balance is not made immediately, an application will be made to the County Court for the issue of legal proceedings. You will then become liable for the court costs incurred as well as the interest which will accrue until judgement has been entered against you. The current interest rate is given above. (8% per annum). Blah blah blah.”<O:p</O:p
<O:p</O:p

Barclays have already issued a summons on 10th May against my son and we are still waiting for a court date. In our defence to the summons I have quoted "Additions" stating that my son never agreed to this. (I saw the video of Whistle Blower on additions).<O:p</O:p
<O:p</O:p

How can they issue a further summons when the case has not yet been heard? I must stress that this threat is from the Manchester dept whereas the first summons is from London! LEFT HAND RIGHT HAND?<O:p</O:p
<O:p</O:p

I truly believe that Barclays are harassing us and "sticking the knife in and twisting it".<?xml:namespace prefix = v ns = "urn:schemas-microsoft-com:vml" /><v:shape id=_x0000_i1027 style="WIDTH: 11.25pt; HEIGHT: 16.5pt" type="#_x0000_t75" alt="0"> <v:imagedata o:href="http://forums.moneysavingexpert.com/images/smilies/angry-smiley-030.gif" src="file:///C:/DOCUME~1/Margaret/LOCALS~1/Temp/msoclip1/01/clip_image003.gif"></v:imagedata></v:shape><O:p</O:p

I wonder if there is anyone out there who maybe retired from working for Barclays recently who could shed some light on this.
<O:p</O:p
<O:p</O:p
The whole thing is confusing and I do not know what to do! Should I respond by telephone and/or letter to this latest threat of a summons and if so what should I tell Barclays.

I will however press steadfastly on! I have not come this far and sent out 13 letters and numerous Emails and defended the summons and reported to the FSA and the FSO for nothing!

Hi we had the same format from Citi (worst Credit Card Company). Did you send the Standard Letter as advised on this site? This gives them 40 days to respond and I would advise you as would the experts on this site, that you "call the shots" i.e. the banks must keep to the timescale as written in their code of practice. The next step is send the 2nd tamplate and keep to the format as advocated on this site. We sent the 2nd template and have just reported Citi cards to the FOS. By the way, we finally received the statements and will shortly be claiming a tidy sum back. Just keep on writing because if they fail to reply, this will go against them in your claim.
Just as a footnote, we are also awaiting a court date from Barclays as they summoned us. The wheels of banking grind very slowly unless they are robbing your account of what little money you don't have. We have sent, in total, around 15 letters, numerous phone calls and emails to Barclays. So, take heart! Good luck:p :money:
Thanks ill keep bugging citi cards they are the worst credit card company ever
• Hi

I had previously posted on another thread - been reading and greatly encouraged - although desperately wanting to get 2nd letter sent out - just wanted to check something first if anyone can please advise me.......
we actually orginally challenged Lloyds back in 2003 about these unfair charges and got standard letter then, but nothing more to go on back then - should i make mention of that initial request in my second letter, and will it have any influence on the case?????
what should i do????

Thanks!
• Hi There Sparky again,
Still not heard anything from Halifax althou i did have to chuckle, on the Halifax thread there is a number on page 12 which i rung. A very nice gent answered the phone and asked what no i rung, i told him and he said "hmm, thats my direct no and i deal with BoS, but i will try and help." I was dying to tell him how i got his no but that would spoil our fun haha.
Anyway does anybody have an address for Studio, its worth sending a letter.

Thanks, Sparky

Hi,

I have a court date with Lloyds tsb defending but since the claim went in i have had additional bank charges. I have been told i need to fill in form N244 to add these charges to the claim but have no idea what kind of wording i need to use on the form in order to do this.

Has anyone out there got a template for this situation?

Any help appreciated.

• Hi i need some advise on how to re claim my charges, i let my wife sort the charges out as i work away all week, she sent them off to court and did not put any bank details on the money claim online paperwork so it went to the district judge who inturn threw it out of court, to reclaim do i have to start again by sending the bank letters of my intention to take them to court or can i apply straight back to court as i have already sent the bank letters before about my intention.

chairman, why dont you phone mcol first before you do anything, explain the situation to them and what has happened and they will best advise you on your next course of action.

I have a court date for my claim (Aug 13th), checking through my charges calculations, the total figure for the detailed calculation list going in to my court bundle is 42 pence less than that I stated in my original claim particulars, and I just can't reconcile the difference. I know this seems a very small thing, but is it the sort of thing that the banks will pick up on and use against me?
