    No that's incorrect the contract is for the handset and the sim why would they block the phone if it was only for the sim??? I'm not saying he's going to do anything bad with his contract but it's too much risk for me look at the situation the man was in 3/4 posts ago I don't want this happening to me.

    He sounds more pragmatic than scared off. Sellers rarely win any SNAD claim so it is often prudent to just get the item back and reclaim fees and re sell it. If he had tried to fight it he would have lost a considerable amount of money in FVFs.

    Do take care to send it back fully Insured though, special delivery with added insurance if necessary, depending on value. Keep your receipt and tracking number in case of problems.

    I've not doubted that they can't but at least they won't be tied into a 2 year contract that will not be in your name nor you paying for it.

    Thats why i said "most likely" locked to a carrier, the PAYG phone is usually only about £10 cheaper than buying it direct from Apple, so most people (in my experience) prefer to pay the extra £10 and get the phone unlocked from Apple, which is often more convenient (you can change carrier at will) and often increases the resale value.
  • ok i work for 3, just to confirm we block the sim, not the imei...the reason we ask for imei is to confirm whether the phone has been reported stolen or is insurance fraud.

    I've blocked hundred of sims but we never block an imei, the phone would still function if you put a different sim in and the contract hadn't been paid.

    The ONLY time the phone would be blocked is if it was reported stolen.

    Unlikely as the OP has made his/her mind up that their understanding of a contract is the only one that that there is, right or wrong.

    You need to read the terms and conditions of such contract. A mobile phone is not blacklisted because of non payment, mobile phone operators do not own the phone you do.

    It may have a subsidy lock that will usually only allow the phone to accept sim cards from the network who originally supplied the phone and almost always there are restrictions in place that only allow the phone to be unlocked once those restrictions have been met.

    Unless the seller reports the handset lost or stolen it will not get blacklisted. I guess you purchased it and attempted to get it unlocked by EE only to get your request refused. Now you want to return it leaving the seller out of pocket with a used phone which now has a lower sale value because of your stupidity.
