I bought a phone on ebay please HELP!!!

  • What exactly did ebay say? Just becasue you have filed a case doesnt mean you will win

    I just told them Exactly as my OP and they said they cannot have sellers behaving like this so I am hopeful of it falling in my favour I think it might violate ebay policies knowingly selling a phone to someone on a contract under your name I have to wait until the 31st for him to comply if not I am escalating it further

    As part of EE contracts now the handset belongs to EE for the first 6 months, it is a breach of contract to sell the phone until then. And as said before is not unlockable until the 6 month time frame!

    how did you contact them? and is this the wording they used?

    Brand new from a shop. Any phone you buy from another person runs the risk of being blocked if they put in an insurance claim.

    2. Equipment. You may get Equipment from Us when you take out a Price Plan. Unless We tell you otherwise,

    (i) place Your Equipment on a blacklist so that it cannot be used on any network within the United Kingdom,
    including Ours, except for making emergency calls and using Wi-Fi. We will give You reasonable Written
    Notice before We do this, which may be by SMS. We will remove the Equipment from this blacklist once
    You have paid the bill and/or any Cancellation Charge which We have charged You; and
    (ii) Remotely disable Your Equipment so that it can no longer be used on any network, except for making
    emergency calls. We will give You reasonable Written Notice before We do this, which may be by SMS.
    We will enable Your Equipment once You have paid the bill and/or any Cancellation Charge which We have
    charged You. We may charge You the cost of enabling the Equipment except where something in point
    4.4.7 has happened. We can change Your Payment Terms as a condition of this
  • you need to understand the difference between new and second hand, if you had bought it new you wouldnt be having this discussion

    If you had of quoted new bought from shop I would of got your gist the phone came new in the box
