As part of EE contracts now the handset belongs to EE for the first 6 months, it is a breach of contract to sell the phone until then. And as said before is not unlockable until the 6 month time frame!

The fact that it was locked to a specific carrier would indicate it is most likely a contract phone, when you buy iPhones outright from Apple they are fully unlocked.0

It's not a great situation as we purchased a traded in phone through a small independent retailer which was blocked by EE exactly 6 months after the contract it was linked to had been taken out as the purchaser had failed to make their contractual payments. The only solution offered by the fabulous EE was to invite us to pay the outstanding balance and remainder of the contract on behalf of the defaulting customer. ergo £350.00 brick0

I agree with the OP.
Last thing they want is for the phone to be blocked if the seller either stops paying the contract or lodges an insurance claim saying it's been stolen.
I would raise a SNAD saying it wasn't shown as being on contract and isn't yet the property of the seller to sell.
Remember to return it fully tracked.0 -
The seller may have no intention of doing anything illegal. Sure, EE say for 6 months they cannot sell it, but that applies to the OP. Their right of redress is with their customer. The second purchaser is not a party to this and cannot invoke or use clauses that are not a party to.
The phone will stay locked to EE and will not be blocked unless the (a) original seller reported it is missing/stolen or (b) they stop paying for the contract. The contract is for the SIM, so they may well use the money for the handset to pay off the line rental.
Considering the price you paid, the deal is reasonable - all things being equal, but not one I'd be content with. I purchase mine from the Apple Store and get AppleCare too.0
