I bought a phone on ebay please HELP!!!

Hello everyone
I was wondering if somebody could please help me my situation is I bought a phone off ebay on Sunday I received Tuesday before 1pm on special delivery as promised it was an iPhone 6 16gb brand new factory sealed I paid £460 for it which I was quite happy with anyway the phone was locked to EE network and I am on 3 so was looking into getting it unlocked when I found out that this phone has not long been taken out on contract the seller who did not mention anything whatsoever in the description about him paying for a contract just that it was locked to EE the listing stated no returns but now after I have found out a bit of history on the phone I want to return it for a refund it's still sealed as delivered but this seller is having none of it I said you listing was not accurate and he said you should of asked these questions before you bought it I think he is wrong. Surely that violates ebays seller policies to put a phone up for auction which he doesn't rightfully own is it? The guy is not even english I can tell by his written emails so who's to say he isn't going to leave the country not honour his monthly payments leaving my phone IMEI number to be blocked? The guy says he's a lawyer which I don't believe so will welcome any legal action. Can anybody help me out with my plight? Am I in the wrong surely not? I just want a refund and for me to return the phone.

I'm confused and I'm sure the regulars will be along to correct me- but a phone is not ' a contract', only the line part is.
It is standard procedure for some people to upgrade their phone contract, but sell on the phone immediately (keeping an older phone for themselves) to pay for the line rental.

That is just the line rental on the sim his monthly payments cover the phone it's just a phone on finance really and like I said if he does not honour his payments my phone will be blocked .
And also the lack of description citing that the phone was on contract he simply only said locked to EE he expected me to know it was a contract phone from this information, I can go into the ED shop tomorrow and buy an I phone 6 for £500 cash on pay as you go just stating locked to EE doesn't necessarily mean it's on a contract.

You bought a phone locked to a network that hasn't been out long enough to be out of contract.

No this is an EE phone provider contract basically gating a mobile phone contract in essence is like a finance with a line rental added to the final bill easier for people to afford rather than stumping up 500 or 600 quid for a new phone so people who say the contract is this sim this is inaccurate as if that's the case why do they block phones which people fail to pay their monthly for?0 -

One of us is confused, and frankly it might well be me.
It still sounds like you are discussing a basic phone contract, exactly like the one I have. I have an iphone as part of a monthly contract , the phone came as part of that contract , I did not pay extra for it but I do pay extra in my monthly payment to acknowledge that I have a 'free' phone. A sim only contract would have been around £10 for my plan, I pay nearer £25 because I have this 'free' phone.
I would be perfectly entitled to sell my iphone now and use a different phone for the duration of my contract.
AS for blocking non payers- they block the sim number, not the phone. No you are wrong I am afraid they block the IMEI number the phones serial number if you like that's why places that recycle phones like Mazuma for eg always ask for imei numbers before they give cash0 -

EE will not unlock the handset until you've used it on their network for a minimum of 6 months.when I found out that this phone has not long been taken out on contract the seller who did not mention anything whatsoever in the description about him paying for a contract just that it was locked to EE
So what, the contract is his to run, the handset is a separate issue to the locking of the handset.Hel

Ah, nothing like a bit of xenophobia. Buying a second hand phone is always going to have an element of risk involved, but he was quite entitled to sell the phone.
My suspicion is that you have discovered the difficulty of unlocking an EE phone and are having some buyers remorse?====0 -

Where does the idea come from that he doesn't own it. If he signed for a contract and is paying the contract he can do what he wants with the handset.

He does not fully own that handset until he's paid his full contract come on you should know this that's why the phone provider will block the imei associated with that phone if he fails to pay the bill if he Owned the phone like you say they would just block the sim. It's like buying anything a car for eg you do not keep up payments the car will get repossessed My main concern anyway is if he stops paying for the monthly contract my phone gets blocked I have no comeback and a useless phone0
