The same thing has happened with me- the bank are saying because the terms and conditions are there, that they can't refund the money. They have said the only way to get the money back is to send the products back and request a refund. Then, if they don't refund you, it is possible the bank will then take over and raise the dispute on our behalf. But everyone needs to check as this payment will be taken every 30 days (£99.99 plus £19.99 p&p). I am so angry tonight!!! I hope we all get our money back. I have lost £199.980

I've been reading all these comments regarding this UK White-time Whitening site and my husband has also been subject to this fraudulent scumbag!
£1.00 was taken out on 28th Aug followed by £99.99 today 10th September. I have spent all evening researching ways to try and get a refund and also reading through the terms and conditions of the website.
I rang the bank and they said they've had so many phone calls relating to this scam and unfortunately because the terms and conditions are on the page, they can't refund. Sorry but if you are not directed to the terms and conditions, how can you be aware there are any?
Secondly, if you pay £1.00 for postage to get a "free trial" of a product, what the hell was the £99.99 for? May as well charged you the fee upfront, but no...because that was the whole point, they wanted to con you, they knew no one would see those terms and conditions. How can this be legal? No mention of terms and conditions in any of the process and not even when you get to the payment portal?
Also another food for thought..... If you try the product and it doesn't work, you are entitled to a full refund...woohooo... BUT in order to get this refund, you have to send the pack back without any trace of it being used? Well, sorry if I am missing something here but how on earth can you send it back unused when you have to bloody open the box to use it, to see if it works?!?! or am i missing something?!
Also... by obtaining a refund, you need to first of all call them, but wait, there are 2 numbers for the company. The one on the terms and conditions does not match the one on the main part of the website. The one at the bottom of the website doesn't work, the one on the terms and conditions does work but only says "Welcome", then keeps you on hold for ages. Blatantly never going to answer that call....
Then you need to in addition to the above, send them a letter WITH your kit to request a refund. So lets get this straight, you order - your 12 day trial period starts from the day you order, so lets say it takes 3 days to get to you, that's not including weekends, so add maybe 2 more days onto that? That's at least 5 days of your trial period gone, because if you look, the trial period isn't in WORKING days, is just says "DAYS", so by the time you've tried it, repackaged it and got it to Poland, oh... what a shame your 12 days are up! I have used snipping tool to print screen anything I can, I have saved the terms and conditions and print screened the payment portal part where, it blatantly shows no reference to terms and conditions. I am ringing the Consumer Rights advice bureau tomorrow and I will endeavor to rip this idiot to shreds.
My husband is so upset, he feels like hes let me down. I am not angry at him, I hate this complete scumbag who thinks hes clever and its acceptable. This is no dignified way to make money!0 -

Thinking about it in reality, if we now dont receive another pack (for spending £99.99) even though its crap anyway, we will be entitled to a refund0

I too signed up for a 'free' trial but once I received the products they had taken out 2 payments for £99. I got in touch with the company about a refund and they claimed that they had cancelled my subscription!!! I was puzzled because I didn't sign up to anything. I continued e-mailing requesting more information and was told I couldn't have a refund because I had signed up to their terms and conditions but they had cancelled any future payments. I'm livid- I have been in touch with my bank who are investigating this. I have e-mailed the European and Polish consumer rights offices- not sure how far I will get there.
This is a job for Dominic Littlewood.
Can I ask how others heard of them- I found an ad on the 'Mail Online!!!0 -

MY BANK HAVE CLEARLY STATED THAT I AGREED THEIR TERMS & CONDITIONS SO THEY WILL NOT BE GIVING ME MY MONEY BACK. ALTHOUGHT THEY TOLD ME THEY HAVE HAD LOTS OF CUSTOMERS LIKE ME. THEY CLEARLY THE BANKS KNOW IT'S A SCAM ARE NOT DOING ANY THING ABOUT IT. I HAVE CANCELLED MY TRAIL & REQUESTED (TWICE) A RETURN ADDRESS TO RETURN THE UNOPENED ITEMS BUT THEY HAVE NOT SEND THEIR RETURN ADDRESS. I'm wondering if their is any mileage in the finanicial obusman with the bank who have told me I will get my money bank if send the product back? the bank keep me referring me to their site & have also gone to the site in the 3 times I have spoken to them. Reading their information to me. they don't give a .....I've disputed the payment but they are adament that I will not be getting my money back. can't afford to lose £99.99 as I am on benefits and also the implications of having £99.99 less this month very upsetting. also bank kindly told me they will charge me if my account goes in the red lovely, even thought they know I have been scamed. anyone else have any ideas about anything that can be done to get money back. Here's what I've been up to since I last posted on 5 September.
1. I have completed my claim form with my bank, and sent it to them in a dossier of 17 enclosures, dating from the time I ordered the 'risk free trial'. It includes, among other things: copies of my phone statements (showing my failed attempts to contact Whitetime on the unavailable number printed in their T&Cs); e-mails; internet articles about Whitetime; a full print out of the website, right up to the payment page (showing no links to T&Cs); and the Facebook site for Piotr Kaszubsky. I am waiting to hear back from the bank, and will let the forum know the outcome.
2. I have e-mailed Harvard Business Services at [EMAIL="info@delawareinc.com"]info@delawareinc.com[/EMAIL], where Whitetime Professional Distribution LLC is registered. The address is: 16192 Coastal Highway, Lewes, Delaware 19958, USA Sussex. I have received a very supportive reply from them - extracts from 2 exchanges as follows:
[FONT=Calibri,sans-serif]"We have received your email regarding the company Whitetime Professional Distribution LLC. Harvard Business Services is the Delaware Registered Agent, but please note we have no affiliation with this company at all. As a courtesy we will forward you letter to our client. [/FONT] We do not condone our clients to conduct any type of fraudulent business and we are doing our due diligence to no longer associate ourselves with them as our client. Were happy to pass along the letter, but we cannot guarantee our client will respond but we hope this helps speed up a resolution for you."
3. I have a registered complaint with the EU Consumer Rights organisation in Poland. Specifically, I am in contact with [EMAIL="karol.muz@konsument.gov.pl"]mailto:karol.muz@konsument.gov.pl[/EMAIL]. Extracts from our exchange so far are below, and I'll keep the forum informed of progress - I would also encourage anyone else in this position to complain to Konsument:
"I hereby inform that ECC Poland received your complaint about Whitetime Whitening . Case is registered under signature provided above . I invite you to rely on this signature due to the fact that it may help us to identify handled case. To determine if ECC Poland can help in this issue, please write us what is your citizenship. If you are British or Irish, European Consumer Centres could help you to solve described matter."
4. Whitetime are still in sporadic e-mail contact with me - continually trying to shake themselves off the hook. I think my case against them is watertight, but so far no refund. Their latest stunt is to claim that they didn't receive their goods back within 12 days, but I am able to show that, from the day they issued me with my reference numbers, the returned package took 7 days to arrive at their return address (I paid extra for International Track & Sign). As a point of interest, the package remained at the return address, uncollected, for over a week, and is now in the process of being 'returned to sender'...!!
Here's a couple of extracts from recent exchanges I've had with Whitetime:

On 10 September, after I'd included Whitetime in my e-mails to Harvard Business Services and Konsumnet, Whitetime wrote:
If the package arrived to us within the 12 days period. You will get a full refund.
On 11 September, I wrote the following to Whitetime (in addition to reminding them of the instructions they had sent me on 19 and 20 August:
I posted the packages back to you on 21 August, using tracked mail, and I can confirm that they arrived at your address on 27 August. The attached screen shot from the International Track and Trace Website proves this.
As the package arrived at your return address 7 days after receiving your reference numbers and instructions (within 12 days), I hope that we can now agree that I have fully complied with your Terms and Conditions, and that you will now refund the charge of £198.98 (2 x £99.99) to my credit card.
I would be grateful if you would confirm receipt of this message, and refund my credit card urgently.
I'm determined not to let this unscrupulous company off the hook, and will continue to chase them (and Piotr Kaszubsky) down using as many (legal) methods available to me. I'll let you know if any of my actions result in anything positive.

What I don't understand is why people sign up for these things in the first place if they have no intentions of ever wanting the product. It's greed, thinking your getting something worth a hundred quid for a pound.
Theres always a catch, these schemes are well known, don't let your greed get the better of you the next time.0
