    No, you are not right in thinking that.

    At least, if you were dealing with a UK company that wouldn't be the case.

    As you are dealing with a Polish company... who knows.

    I feel your only hope is to insist with your bank that you never agreed to any T&Cs, nor were you ever asked to agree to any T&Cs.
    A couple of us have been able to confirm that that is the case up until card details are needed, but it is possible that on a later screen, before you hit 'confirm order' or somesuch, that you are asked to agree to T&Cs... but you say not.

    Keep insisting that you didn't agree to any T&Cs and then hope that the company doesn't challenge that.
    If they don't, then a chargeback should stick.
  • I am a careful shopper online and have NEVER been duped but I don't understand, how can you cancel your agreement with a number that is not in use and how it can still be a valid contract with false information?

    Just because the phone number doesn't work, it doesn't mean the whole contract is void.

    They do offer an alternative method of cancelling the contract... I have quoted it in post #5.
  • This has just happened to me, I have asked them what the £99.99 was for because if its for the item i received I didnt request it, then where is the free trial pack ??
    I had already cancelled with the bank and they said in email they cancelled my subscription not very helpful.
    I have told them i want a refund or i will bring my complaint to the consumer ombudsman as I wasnt directed to terms and conditions and they are being very deceptive dupeing people into this a monthly subscription.
    I also would be interested to see if anyone has any advice.
  • I've fallen for the scam too, and feel a complete fool. However, there was no indication whatsoever, during any part of the 'risk free trial' sign up process, that £99.99 would be whipped out of my credit card account. I'm following up with my bank, but here's what I know:


    The guy behind Whitetime is a 21 yr old Polish guy called Piotr Kaszubski - check out his facebook sites. He also owns a company in Warsaw called Estinity, and he's already made millions out of this internet scam.


    I've been in touch with a journalist (Michal Wasowski) who has interviewed Kaszubski and investigated Whitetime - look him up online and translate his articles. Michal was very helpful and tells me that Whitetime has been taken to court, and Kaszubski's mother is presently facing a jail term (darling Piotr registered the company in her name without her knowledge).


    Despite all that, Whitetime is still active today, and it's distribution centre is operating out of Warsaw, so I have written to Konsument in Poland (equivalent of our Consumer Rights) to highlight the scam and ask what can be done about the company and my money (konsument.gov.pl) . Why don't you all do the same (info@konsument.pl)?


    In truth, I don't hold out much hope for getting my money back from Whitetime, so I'm hoping the bank comes up trumps. Be aware, however, of the other clever trick that Whitetime employs - £99.99 is one penny less that the £100 threshold that normally trigger a bank's intervention. I've told my bank what I know about this company and appealed to them to recover my money and not contribute to further lining this scumbag's dirty pockets....

    Who/what is this 'consumer ombudsman' you speak of?
  • It's the European Consumer Centres Network in Europe (ECC-Net) and it's set up to help resolve cross border disputes for consumer transactions that occur in the EU. My advice is that you check out their website and contact them with your grievance. It probably won't help you to get your money back, but raising awareness of Whitetime to the authorities may help to close down this scam operation, and prevent other innocent consumers falling for the same trap.
  • the same thing happened to me today,i had an email telling me they were taking £120 out my bank.i phoned my bank who said it had already been paid but they would put a debit dispute on it.after looking on this website made my mind up to phone the bank again.a different person told me that i had 2 payments taken out of my bank,both in august,one for £1 which was for the post and packing for the trial offer and a few days later £99.99,i,ve lost over £200 and im foaming !!!!!

    I empathise with anyone getting caught in this, but my first thought would be , how the hell do I know what chemicals I am being sold?
  • Hi just seen all your post as I was scammed on 20/08/14 like many others on facebook after reading the article! Just to let you know a group has been set up on Facebook called whitetime con which I have found very helpful. Unfortunately even though this has been reported by many to trading standards, fraud team and Facebook. This article http:/huffingtonpost-beauty.com/24-million-people-in-the-uk/ is still on Facebook daily.
