Neighbour parking overhanging driveway

I am not being 'overdramatic'. I am being conscious about what I have to do.
I have always been a careful driver and have never had a problem really at my driveway until my neighbour got the car.
As I say it is a one-way street and I am not prepared to damage my car in any form or manner due to an inconsiderable neighbour who deems it satisfactory to park over the driveway.
Actually I do have a similar situation, which is why I was following this thread in the first place. I live on a narrow one-way street and someone parks directly opposite my drive which makes it a little less convenient to get in BUT it's completely do-able and it is certainly not "endangering lives" as you put it. I definitely wouldn't consider complaining about it as I passed my driving test having been taught to use my mirrors and manoeuvre a car safely.
I think you are being over dramatic to be honest and unless you are being completely prevented from getting in and out, then you don't really have a leg to stand on. What you are basically complaining about is that it's a little more tricky to get in and out quickly.0 -
Park on the road outside your drive right up to the disabled bay until they get the message.
Is the disabled bay even fully legal? Council here seem to paint them outside peoples houses willy nilly but they have no traffic order on them or signs up saying that it's a disabled bay, etc.0 -

At the end of the day, it is an issue when she keeps coming further back and parking further over it. I can't keep worrying about whether I can get in or out safely. There is also a van at the other end making my view restricted, and as I say it's a fast and busy road, other drivers don't think about anyone coming out of driveways, so it's an accident waiting to happen because of this.0 -

The disabled bay is not fully legal as doesn't have the sign up yet which my Council have not enforced the TRO on any of the spaces yet.0 -

Not tit for tat at all. If someone was everyday parking next or opposite my access blocking me in, I'd just be parking outside my access until they got the message. Better than being blocked in/out.0 -

The bay is used by another neighbour. There is other spaces available in the street at most times, you don't have to see your car at all times.
It is not residential parking, hence the reason the driveway was put in.
Before I had the driveway I had to park miles down the street as there was no space at my end. I didn't just decide to park my car somewhere where it would cause a hassle.0 -
If you have a dropped curb, the council should come round and fine anyone parking over it. Have you contacted them? Also the police should move the car if it is blocking you in and parking over a dropped curb but unfortunately not if you are already out and trying to get back in. If you can't get out phone 101.0

My solicitor has advised to go for an anti-social behaviour order or an Interdict which I now feel is my only option if the Police can't do anything.
Can anyone help? Is the Highways Act 1980 legal in Scotland? As there is a Section in this which could help me and as far as I know the Highway Code is United Kingdom fully.
Any help would be greatly appreciated.

You sound quite like my neighbour - She called the police on me because I apparently slightly parked over her drive.
The police attented my house and talked to me about it and said they couldnt do anything as I wasnt doing anything wrong and not parking in front of someones drive is just a courtesy.
I think the best way of dealing with this would be to talk nicely to them - Sending a soliciters letter has prob just made it worse for you as in Scotland theres no law to say you cant park infront of someones drive.0 -
Still not clear. Is she obstructing your driveway by parking with her wheels on your drive? In which case you can put a bollard on your drive. If the disabled bay then prevents her accessing her drive that is the council's problem. Does the disabled bay prevent you from clear access to your drive? In which case I should have thought you could have taken action against the council for obstructing your access. Not sure how it works in Scotland, but if the second is true, would approach them to take it up with council officers on your behalf.0
