Neighbour parking overhanging driveway

My neighbour got a car in May and since she got the car she has been parking overhanging my driveway constantly making this a complete hassle for me to get out of my driveway freely and safely. Have asked her to move her car which she ignored and have been to local housing about it but they won't help at all keep saying they can't do anything and police won't do anything.

I live in Scotland and need advice have been to a solicitor who wrote asking that she desist from parking there but she continues to do so and has admitted she is doing this but still nothing happens.

I feel a complete wreck and feel like I'm being trapped in my own home as she has worked out my times for coming in fromm work and taking my daughter to her activities.

I need something to be done. The main reason this is also happening is because of where my local housing put a disabled parking bay int he street leaving not enough room for a car to park in between my driveway and the space, which the Council have refused to move which I feel is unacceptable.

My solicitor has advised to go for an anti-social behaviour order or an Interdict which I now feel is my only option if the Police can't do anything.

Can anyone help? Is the Highways Act 1980 legal in Scotland? As there is a Section in this which could help me and as far as I know the Highway Code is United Kingdom fully.

Any help would be greatly appreciated.

    when she does move the car ..put something on the very edge of your drive ..maybe even your own car

    can u not put some sort of bollards or chains or fence there so she cant encroach on ypur side

    If parking and space is an issue park your own car there and take up as much space as possible.

  • My mum's neighbour placed 3 very large rocks on the grass verge outside their house. Not sure if its legal, but stops anyone from parking there as its a narrow road and people always used to park with two wheels on the pavement (not us I hasten to add. My parents have a long driveway which accommodates 5 cars).

    Buy a cheap, road legal moped. Tax and insure it and park it where she likes to park. Possibly cheaper than solicitors.

    Taking that into account there is not ample room between the disabled bay and my driveway, so no she can't, but I have contacted the local Council to ask that they consider removing that bay and putting slightly further forward to alleviate the problem to which they advised they weren't willing to do anything.

    It isn't illegal to park in a disabled bay as the Council have not enforced the signs as yet but I'm not one to do this but feel I may have no alternative but to do so.

    As I say it's the audacity of her admitting she is doing it but not willing to remedy the problem by parking elsewhere or parking overhanging the disabled bay.

    Believe me, I am considering using this option as feel like I'm going to end up mentally and physically unwell.

    If its got that bad, just reverse into her car a few times as you get into your driveway; she'll soon get the message and you'll feel a whole lot better. With photos of her overhanging a dropped kerb (I presume it is a dropped curb? - if not she is entitled to park there anyway) and therefore illegally parked, she may even be attributed a portion of the blame and lose her NCB.

    I wouldn't think so, you can't collide with a parked car and claim it is their fault that you ran into it, even if they didn't leave enough space for your manoeuvre. However, her policy will get more expensive due to the claims

    However if she is alongside your dropped curb, you might be lucky and find that your local council will send the Parking Man on his little moped to give her a ticket - try 'phoning them to see.
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))
