ebay blatently stole my money

I live in England. I bought an item from America on ebay.
When I bought the item I accepted the default delivery address as I always do.
Ebay USA gave an old address so I contacted the seller with the correct address.
They were happy to post there.
In jumps the Global shipping thing who post it to my old address.

Today after a dispute over it, I got this...

Customer Support has reviewed the case and made a final decision. We've considered the case carefully and decided not to issue you with a refund. We're sorry this didn't work out.

Decision:
This case has been decided in the seller's favour.

Comments:
We received tracking information from the seller that shows the item was delivered to your address.

In response to your claim, I have fully reviewed the details and can see that the seller has provided proof of tracking indicating that the item was posted and delivered to you. Because of this, the case cannot be closed in your favour. We also cannot approve an appeal of a case decision where tracking shows an item has been delivered as we must take this as proof of delivery.

I understand this is not the resolution you had hoped for but I trust I have addressed all your queries, as always our aim is to assist you in the most efficient and professional manner.

    You ring them and talk to a real person and say that the item was never delivered and sent back to the seller ... they will sort you out.
    People don't know what they want until you show them.

    Strange what is the reason for not refunding if tracking shows undelivered?

    Possibly they look at tracking and the first word they see is DELIVERED?

    And the final destination is the sellers address?

    I can't understand if you rang them and said 'Item has been returned to sender and the tracking shows this, if you read it though you can see it's been to my address then back to sender and then delivered but people won't help me because all they read is delivered...?

    eBay are usually really good in these (when you ring them) :(

    I call it incredible stupidity but I have to work with it.
    I am usually good at sorting things out but I'm not sure about this.

    If you can't get eBay to agree it's going to get really complicated with the seller being in the US to take it further. I'm failing to see why a real person can't see that it's been sent back to the sender - and if your on the phone to them that you can't break it down for them so they know.

    FYI: Their is a eBay section on this fourm, I'll edit in the link if you want more advice.

    This is the first case I hear of that is reloved in the seller's favour! There should be further tracking information once the seller receives it back. Could you contact them to post it to the right address this time? As a rule, your address should always be up to date with paypal as most people only send it to the confirmed address. That doesn't help you now but maybe in the future.

    I speak to people at ebay in the UK and they say don't worry, I will get a refund.
    America does not see it that way.

    Sadly it is having a dramatic affect on my sanity.

    My address is up to date.
    Sadly I have not worked out how to remove old addresses.
    I do not find ebay very user friendly for things like that.
