No, breaking the law is not the answer. It would not take much to prove the buyer has the item. The messages to the seller, the thread on here.....are you completely stupid?

If the buyer rings eBay, they will probably refund the postage or supply a label. But as it stands the buyer seems more intent on getting a discount on something she found so SNAD she posted here.

I believe the only proof eBay will accept is a signed for delivery note. The seller could have a picture of the OP from the front page of the local rag holding the bag and a signed affidavit from the queen and eBay still wouldn't award in the seller's favour. People post threads about it on here ALL the time.

Since when were eBay the law? eBay would be the least of their worries if the seller wanted to take this further.

Winning a case is nothing to do with being law abiding.

Committing fraud however is another matter entirely, I have already identified both buyer and seller, not difficult at all.

And for the record, no, a 'signed for delivery note' is not protection. Have a read of the sticky and refrain from encouraging others to break the law.

I'm sure this case would be laughed right out of the police station, never mind court.

    From your precious sticky:
    Key rules of Seller Protection

Ensure that the item is “Eligible” for Seller Protection, as displayed in your ‘Transaction Details’. Your ‘Transaction Details’ are in your PayPal email receipt. You can also find your ‘Transaction Details’ by logging in to your PayPal account and clicking on ‘Detail’ next to the relevant transaction.

Only transactions between UK, US or Canadian buyers and sellers qualify

Post to a confirmed address, as displayed in ‘Transaction Details’. This ensures that the item goes to the buyer at an address we have details of.

Retain proof of postage that can be tracked online, such as Royal Mail’s Recorded Delivery. If you hand deliver an item, or provide delivery in a way that we can not track online, your transaction will not qualify. This includes items posted with first class postage.

For items with a value of £150 or more, you need to provide proof of signature from the recipient (RM Special Delivery)

You must be Verified, and have a Premier or Business account

Post the item within seven days of receiving payment

Only accept payments in full from a single PayPal account

Please respond to all PayPal enquiries within the deadlines as disputes need to be resolved within a specific time frame.

These are just some of the key rules of Seller Protection. Please refer to our Seller Protection Policy for full terms and conditions

What methods of online tracking are acceptable?

The following options may be used:
    Parcelforce Worldwide
    Royal Mail - Special Delivery
Royal Mail - Recorded Signed For
Royal Mail - International Signed For
    Royal Mail - Airsure
    UPS
    FedEx
    Airborne Express
    DHL

    Who mentioned a police station?

Nothing about messages between buyers and sellers there.

    From your precious sticky:

Thank you I know what's in there. And a 'signed for delivery note' isn't one.

It has to be ONLINE tracking. Or did you miss that bit that you managed to quote?:D:rotfl:

You really are missing the point and I shall not labour this anymore as you clearly can't grasp it.

Breaking the law is one thing. Proving delivery for an Ebay case is another.

You clearly need to have a good read through the sticky, as you seem to have muddled yourself up too much.

If someone went to a police station and said someone had committed fraud I would hope no one would laugh at that, it's a serious matter. Sure, it seems silly over a bag but it's still fraud.

Either way, OP wants to be honest (as they should be) and go for SNAD. In the end they'll get a full refund and they'll know they didn't lie. So saying they should say something else or could have gone for INR is pointless.

What gets shown online? A signature confirming delivery. You could call it a signed delivery note, could you not?

In any case, this seller has no proof of delivery whatsoever, so your point is moot, presh. :rotfl:
