    Just re-read what the guidance says about ANY holiday abroad for ANY length of time whilst receiving ESA - Talk to your local Jobcentre Plus before you go.

    I can't make it any simpler for you. If you want to tell me that this is not true, then post the guidance that you are relying on.


    Even other posters who have checked it out for the purposes of this thread agree with me that what I have quoted is correct.

    Employment and Support Allowance (ESA)

    There are 2 types of ESA - income-related or contribution-based.
    You can get both of these for 4 weeks if you go abroad.
    Talk to your local Jobcentre Plus before you go.

    The DWP are talking about holidays that DO NOT EXCEED 4 weeks.


    Why are you arguing with me, surely you should be taking it up with the DWP who after all pay the benefit.
  • That has nothing to do with going on a normal holiday.

    Disabled people in this country have every right to take a holiday without informing anyone at the DWP.

    Actually requiring a disabled person to inform the DWP of a normal holiday of less than 4 weeks would be discriminatory.

    Oh here we go the discriminatory card is being played now.


    The guidance I quoted is very clear - you either abide by it or don't - it's your choice. If you receive disability benefits - you are told to discuss your holiday arrangements with the DWP no matter if it is for one week or 1 month BEFORE you go.

    He is correct though it is a discriminatory regulation.

    More and more of them are coming to light and many were written a long time ago and are outdated.

    If you went on holiday for a week and didn't inform them and they some how or another found out and stopped your benefit (which would be highly unlikely) you would have good grounds to say they had Discriminated.

    Going back to the OP some form of photo id, seems to be needed more and more these days! Which is why we need a National ID system like all the other countries in Europe has. As long as they don't charge us a fortune for the ID!

    It MAY be discriminatory - that is for the courts to decide, not you or me.
    If you think there are some laws that do not fit the times that we are now living in, you should be taking it up with your MP. Personally I can't see it being as you are asking the government to pay you money, with that comes conditions, right or wrong. If you don't agree with the conditions, then don't claim the money.


    Now I agree with that. Everyone should be forced to carry with them at all times a government issued ID card, that carries details on a chip of immigration status, personal details, health details and more importantly any previous involvement with the police whether prosecuted or not.
    It should be made compulsory with a heavy penalty imposed.

    Actually MP's are not much use when it comes to discriminatory legislation. If someone had their benefit stopped, they could appeal which would then give them the forum to point out the relevant law to the judge, who would make the decision based on existing case law.

    Not sure about a National ID card, simply because we could never trust governments not to increase the remit of it.

    But, a passport is simple, in that it's got a dual purpose (holidays and ID).

    As a side issue, have just spoken to an old colleague at the JCP, and she was slightly bemused at the concept of numerous claimants phoning to tell her where and when they are going on their 2 week summer holidays this year. :eek:

    You can tell a lot about a woman by her hands..........for instance, if they are placed around your throat, she's probably slightly upset. ;)
