Don't, I think if you stuck to RC's template you should win. Even if you don't you will more than likely win in the SCC.

I'm 99.9% sure I included the CPI and RPI percentages as I figured it was important to show some proof that CPI is consistently lower than RPI.

I'm still kicking myself for not including compensation. I wonder if I can request compensation directly from EE after and if they refuse, open another claim for compensation with CISAS?

It might be worth you phoning CISAS to see if you can withdraw your claim and resubmit it.

Is it possible to submit a new complaint with new info, after adjudication?

My gut instinct is that you may struggle to get the compensation now. On the other hand though it might be worth a try, as it won't cost you anything.

I think the main thing though is having the contract terminated - well it is for me as my termination should be backdated to February, which is only two months into a two year contract!

I very much doubt it, as whilst you may include new information the argument is essentially the same as your previous claim. RC may be able to clarify this.

As previously stated though if you take it to SCC you will more than likely win.

Give CISAS a call and see if it is too late to withdraw you current submission (make it clear though that you want to submit it again with new information).

I would like to see EVERYONE who as benefitted from Randomcurves hard work THANKNG HIM !!
Over 54000 people have viewed the thead -yet RC has only 417 "Thanks" against his name !!

I had until 8th April to reply back to EE defence. I sent the reply back on 2nd April, so far not heard anything. I assume I will get a reply back after 8th April to say who has been assigned to my case.

I had decided long time a go if I was awarded £100, I will donate it 100% to a charity....

That's what I was thinking, no harm in trying. Termination of the contract is number 1 priority though. Although I'd like a wad of cash in my pocket after, haha.

If they defend, which I'm told they will, surely at this stage I can submit my argument against their defence mentioning RPI etc?

I know it would have been better if I had done this in the first place, but can I add it into the case then?

I guess it depends what you have included in your claim. As when you receive a defence from EE the accompanying letter states that your comments should not include any new information which you previously forgot to mention.

Once again RC will probably be able to clarify.

Maybe if you post what you have written in your claim, we will have a better idea as to whether it is likely to succeed in its current form, or whether you can strengthen it in your response to the EE defence, or whether you should withdraw and resubmit.

I am on an EE contract, taken out in September 2013.

I foolishly didn't use all of RandomCurve's template, I wrote my own submisions using a lot of his wording. However, baldyj is right, I didn't put in the RPI - CPI bit.

The adjudicator was Thomas Earley. Good luck to anyone else who has him as theirs.

Does anyone know how to start a SCC claim?

The same adjudicator was assigned to my case and I won, I was on EE taken out in Dec 2013. I used all the templates provided by RC.
