We really need names of the adjudicators and their decisions.
What happens when you lose your case? Because some people have own, it wouldn't seems fair to win and lose some at the same time, it just doesn't seem consistent.0 -
I am on an EE contract, taken out in September 2013.
I foolishly didn't use all of RandomCurve's template, I wrote my own submisions using a lot of his wording. However, baldyj is right, I didn't put in the RPI - CPI bit.
The adjudicator was Thomas Earley. Good luck to anyone else who has him as theirs.

I used none of his template as I didn't see it until after I submitted it. It's not a huge deal for me as although I have two contracts with a long time remaining, they're a total cost of £30 per month. Two sim free would only save £10 or so.0 -

Well at least that explains the inconsistency of the decision. Although I still think it is wrong because the adjudicator has admitted there is a detriment, and in the absence of a definition for material detriment, the meaning most advantageous to the consumer shall prevail!
It's a shame you can't appeal the decision, but I'm sure for anyone who fails at CISAS Random Curve will don his cape once more and assist with SCC claims.0 -
