    A question,

    My adjudicator decided that I have to give 30 days notice, therefore moved my backdated date forward 30 days. But only two other people have had that happen to them.

    Does the 30 days notice period apply in this case?

    It depends on your contract exit clause for the change in terms and conditions. I was on Orange Pre Oct 2012 and my clause had a 14 day notice. Check your clause and if it too has a 14 day notice period then write back to CISAS mentioning the same and hopefully they will amend the decision to reflect the same (as long as you have not accepted it).

    Therefore, my decision is that the company shall cancel the customer’s contract with effect

    from 11 February 2014, without applying a penalty for doing so, and provide the customer with

    a PAC. All charges incurred on the customer’s account from 11 February 2014 onwards shall

    be waived, and any payments made by the customer in respect of the waived charges shall be

    refunded. The company shall also pay the customer the sum of £100.00 in compensation. The

    company shall request an unlock code from the customer’s handset manufacturer, but is not

    obliged to provide the unlock code if the manufacturer is unable to supply one.

    Sent of two RC templates (one for me and one for the wife) in response to EEs reply to CISAS. As far as I can see the next step it to be assigned an adjudicator. I'll report back as soon as that happens as well as look up the likely outcome with them.

    Like most here I could not have done this without the splendid Random Curve - thank you for your help.

    Notified today that I have won my case. I was on a Pre Oct Orange contract and used all of RC's templates.

    However I wasn't awarded any of the £100 compo. The gist of it was that my adjudicator thought that they were acting in good faith and notified me of my rights when required to do so.

    My adjudicator was Alison Dablin. :beer:

    Some funny snippets from Alison, reads like she was a bit annoyed with them;

    "The company has submitted that the dispute falls outside the scope of the CISAS Scheme. I do not accept this.The dispute clearly relates to the contract for the provision of communication services."

    "... I consider it to be against the spirit of the CISAS Scheme to ‘cherry pick’ only those terms strictly relating to the actual provision of the communication service as being admissible."

    "I also do not consider the issue to be a complicated area of law ...the company is not able to hide behind an argument of ‘unclear construction’ in order to avoid the dispute..."

    "I am also not persuaded that the issue of determining material detriment falls outside an adjudicator’s competence"

    EE have come back and stated that they will credit my account with the money they sneakily took out!

    Dear Sir

    Thank you for your email, the contents of which have been duly noted.

    I am happy to arrange for the sum of £18.71 to be refunded, however, you will need to contact you bank directly to cancel the direct debit instruction to avoid further payments, if any, being debited from your account. We kindly ask that you allow up to 14 working days for this sum to clear.

    That's why I said cancel the direct debit
