Just got this last response after sending the emails about material detriment
am sorry you remain unhappy with my response.

As a company EE does not accept there has been any material detriment due to the recent proposed change in its terms and conditions. !Under these circumstances any request from its customers to be released from contract without penalty will be declined. !Any customer wishing to cancel their contract may do so by providing the relevant 30 days notice period required but they will be held liable for any early termination fee.

The company, EE, have fully complied with the General Conditions set out under Ofcom regulations and as the previous emails and this one sets out fully the final position EE has taken, no further discussion will be entered into with regard to this matter.

Whilst I understand this is not the outcome you were looking for, I trust I have clarified EE's position regarding this matter.

Looks like they think they can decide what it means!

I don't think anyone ever expected anything different from EE to be fair, they were never going to just give up because it would open the floodgates.

However the highlighted section above at least means you can now go to CISAS immediately. Good luck, a lot of us are very close behind you. :T
A big believer in karma, you get what you give :A

If you find my posts useful, "pay it forward" and help someone else out, that's how places like MSE can be so successful.

It would be rather nice - if we won a court case - and due to EE's reluctance to pay up - if we ended up sending the bailiffs in to EE's HQ !!
  • I sent my initial letter using a slightly different template I found on another website on 10th February. I got a read receipt about an hour and a half later but since then have had nothing.

My email stated I was giving 14 days notice, inline with clause 4.3.... should I send another email, or wait the 14 days?

Isn't that other website to do with last years issue ?
    Rather than this years ?

It is, but the theory is the same...
  • I also have two 4G tablets that fall under the same original Terms And Conditions, can I include those too?

Don't count on cisas for anything as I have already stated that they tend to favour the provider. Be prepared to raise a small claim against EE in court but you will first need to pay off the remainder of your contract and then raise the small claim (doesn't cost much to raise one).

I have seen a previous case where cisas have stated that they cannot provide a legal perspective to terms stated in the contract and hence simply decide in the providers favour putting a note that it does not stop the individual from raising a claim in court. I believe this is where it will ultimately end.

Thank you for your email regarding the recent text message you received.

Please be advised the text message sent to you was not sent to notify you of a price increase but to advise you of a change in our network terms and conditions which will be made from 26 March 2014.
As a company we wish to provide clarity on the terms to ensure customers are provided with more certainty and transparency in the event of us making any changes to your price plan. !The update in the terms and conditions supports the guidance Ofcom recently issued around fairness in contracts around several issues, including price increase in contract. !The change in the terms provides greater clarity on price increase notification, which includes the instances when you as a customer have the right to cancel a contract without charge.
In addition to the above we have signed up to the government's Telecoms Consumer Action Plan which aims to improve the customer experience in a number of areas, including bill transparency and certainty over the lifetime of a contract, in line with the principles of Ofcom's guidance.
I trust the above explains more clearly to you why the text message was sent to you.

    Yours sincerely

    Executive Office,EEi

I've got my first rely back
  • I've just had my first reply back, the title is FW: Terms & Conditions 2014. The wording is the same as everyone else, so this is the same email they have forwarded on to everyone... this isn't a very professional approach from a big company!
  • got the same copy paste second email,
(not a price increase yada yadaa) after I resent the original mail.
For your info, it appears if you reforward the original email, they have a script set, to autodelete.
Resend with a copy paste and they eventually will respond.
I have sent email number 2 and will let you know how I get on, thanks for all your help so far Random and the rest of you.
