If at has been 8 weeks go straight o CISAS and change the £25 claim for bad customer service to £50 and quote "stress caused by refusing to communicate with you" you can add the read receipts in your evidence.

Good luck - lets try and get you £125 !!!

    Ahh, right..
Went with the formal letter of unsatisfactory service and included print outs of emails and read receipts and sent it recorded delivery to Orange customer services..

Will just have more evidence when we go to CISAS in 2 weeks time

I had a part win in September from CISAS, but T-Mobile failed to abide with the decision, they charged me for 2 PAC's but removed one of them and refused to remove the other, they did not pay the £50 compensation on time, this is the bulk of the letter i received from CISAS the other day..

Any new issues must be addressed directly with the company’s complaints procedure in the first instance.

Our involvement with this particular case is now over and we are unable to assist you any further.

Should you wish to take this existing matter further I would recommend that you seek independent legal advice.

    Kind Regards

I really find it difficult to see the point in CISAS if you get a decision in your favour yet they fail to follow up on it....

This is exactly what I am afraid of. RC what if this is to happen to our cases where do we go from there??

    RC - MSE legend!

Won - termination of contract and £100. [Removed by Forum Team] was in the chair and I followed the templates, and was on an EE contract.

None of this would have happened if it wasn't for Random Curve. Thank you

But they did pay the compensation, just not on time?

And charged for one pac code, I know they shouldnt have charged for any of the pac codes, but they paid the compensation albeit late.
I cant imagine they will want this to go any further, sc will pay out for sure as an adjudicator has already deemed they are wrong to have changed the t & c.

Also update on my second contract
t-mobile, post october 2013, won, awarded pac code, £100 comp,
    adjudicator - Uji Obi

On my previous win, adjudicator was Eisei Higashi.
So in summary, 2 wins, total of £200 compensation, (100 for each).

Again a massive thanks to RC, you have saved me well over £400 in the remainder of the contracts alone, but more importantly, have cost the ever arrogant ee some money.

Did you do two claims for your contracts or one claim for the both of them?

Id be surprised if they don't follow through with cisas's decision. IF it was just the one case they'd probably try get away with not paying but seeing as it's at least 30 so far they wouldn't have a leg to stand on if we went to ofcom, especially not if we went to scc.

    Who was your adjudicator?
  • Hi Jon1555

I raised these as 2 seperate claims, a couple of weeks apart, reason I took so long to post from my first result.
Basically, I felt EE should be played at the own game, they sent me 2 seperate texts, so I raised them as 2 complaints, (with a view EE would get stuck twice with Cicas charges).
I sent seperate emails to EE, making no reference to the other contracts, so all emails would only relate to the one number and vice versa.
A real shame my wife and son arent with them anylonger, or I would have hit them 4 times >)

Thanks for letting me know, i initially done my two as single claims but then cisas rejected the multiple saying it should all be as one. Will be interesting to see what the adjudicator decides on, especially seeing as ee refused to recognise one of the contracts in their defence!!

    Hi RC,

I was just wondering whether it would be better to continue to write my case for the SCC,or to start fresh and appeal the price rise if that is a much easier case to win with the CISAS?

I'm going to post the SCC "Letter before action", but as you are on a pre Oct 2012 T-Mobile contract then for you it ,may be best to go down the price rise route. Your case should be "cast iron" (baring getting a certain adjudicator!!!), because in 2013 T-Mobile applied the MARCH RPI published in April, whereas this year they have applied the FEBRUARY RPI published in March - so they have applied 12 months inflation to your contract over an 11 month period!!!
