You can only work with the system in place at the time of the incident. If you wish to campaign for change then whilst commendable it is not relevant to the claim in hand.
Really you need to work out what outcome you want, what you expect and what you will be satisfied with whilst recognising the confines of legislation and regulation in force at the time of the incident. Anything else is for when this battle is done0 -

Oh Hachette, I'm afraid you may have only just started on what could be a far longer case to close to your satisfaction. Legal cases can take years if you have to go to court and the defendant wants to obstruct, etc depending on which track you enter.
As I recall, this isn't about the money (which is as well as it may end up being expensive) but about the vet you believe acted negligently and incompetently, and having them censured. Cash can't pay for that, so this is not small claims court stuff (that's just money from insurers) but a career on the line, it's going to take significant time and money if you need to force that point.
Several months could be just the start if you want to continue down the personal route, the cash from the insurers route will be quicker, but all along I think you've said this isn't about the money?0 -

Hachette, is there a reason you won't go and free legal advice?
Firstly when I did get legal advice in January (not free) it was very negative. I was told to wait what RCVS will do and how little chance I have to stand up against them. Since my solicitor or rather barrister was also qualified vet he knew very well what RCVS will do with my complain i.e. close it. Secondly soliciotrs will not take case as mine because of small amount involved. Thirdly I must wait what the veterinary practice insurers are going to do. If they offer what I am claiming which they may after seeing the forensic report then I cannot go to court. If they don't then I will approach my house insurer’s legal team. It is all waiting game now.0 -

I do not wish to destroy my ex-vet career as she is only young but I strongly feel that she needs further training before allowed to make such decision as she had made with Maxie and let back to practice. The worst part is that 5 professionals took care of my dog and they all covered for her. How does one deal with that? According to the forensic report there was no way they did not know what was happening with Max. I have appealed to RCVS with a hope of achieving that, my claim is secondary matter. If it will take time and money to force that point that it what I am prepared to do.0
