I have appealed to RCVS
I'm not posting this to upset you, but.....
For many years I dealt with literally thousands of letters of complaint about and appeals against Council Tax bands and prior to that rating assessments.
Sadly your letter is not an appeal, it is at best a complaint, at worst a rambling, emotional and libellous rant (and I have read it about 6 times).
If you wanted to appeal against the RCVS decision, you should have written something along the lines of:
"I refer to your decision in the matter of xxxx and would ask you to reconsider for the following reasons. (then briefly list the reasons 1, 2, 3 etc)
I trust you will give further thought to this matter and I look forward to receiving your early reply".
Always keep such letters brief, to the point, unemotional and business like.If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0 -
QUOTE e-mail I just received "The insurers emailed me on Friday with a query, which I responded to. I am currently in hospital but will be let out tomorrow, I had to have major back surgery on Monday, so can you bear with me and I will contact them on Monday next week.
My ex-vet has personal problems and now the insuance brokers too0 -
I can not take this any more. 14 th of December is when Max died and that is the dayI will take to court. That e-mail is just too much.0

The judge will be very sympathetic about your loss but will rule against you. Then he will put on his black cap and award costs against you.
If your dog felt half as much for you as you do for him, he would not want you to put yourself through this. You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'0 -
I think it's good that they are dealing with you personally though, that's a positive0

So are you going to small claims court, to claim for your vet fees and consequential losses? The judge will either agree with or not, you will either get your money back or you won't.
Your other issues will not be addressed in the least, that is not what small claims court is for. Even if the judge finds in your favour financially, it's no admission of guilt, it will be a simple case of 'the dog died, should you get your vet fees back?'
Or are you willing to spend the tens of thousands of pounds it's going to take to go to a higher court?Accept your past without regret, handle your present with confidence and face your future without fear0 -

I don't chino this is bad to be honest, would it have been better had they not told you and just got on with it on Monday.
On the positive...the insurers have read your report, they have asked the broker a question, the broker will respond on to the insurers on Monday. This is GOOD NEWS. This was never going to be quick, you need to strip the emotion out of this. You won't get very far in court if you havnt allowed reasonable time for the insurers and co to examine documents and complete their investigations.
My advice for what it's worth..... Consider this a positive step, they are investigating, things are moving forward and you are being kept informed by the broker. Allow things to reach a natural conclusion (ie when they respond in their final statement ) before considering alternative actions and legal action0 -

On what basis do you think the judge will rule against OP? They seem to have strong evidence in their favour.
And what on earth makes you think the judge would award costs? That's just a ridiculous assertion.0 -
This is why the whole situation is driving me mad. When Maxie bled to death (exactly I year ago) I knew this was not right. Not something that should happen after biopsy. Everything that I have done afterwards e.i post mortem report other vets advice and forensic vet report all supported what I have already suspected from the start even as a lay observer it was clear you do not operate on a dog while his blood had no ability to clot and yet some of you think that the judge will go against me. Well maybe but have to wait and see.
Peachyprice yes I am willing to spent what it takes.0
