    I disagree; it's pretty straightforward.
If you're claiming the policy was mis-sold & they agree, they will cancel the policy and give you back the premiums you paid (plus interest). It will then be up to you to find an alternative. If on the other hand you're quite happy with the policy, then you've no reason to claim compensation and you carry on as normal. You can't have it both ways.
That I understand but only to the date/year the policy wording was changed otherwise it means they are still miss-selling the policy this year which they arn't

It makes no difference when they changed the wording. You were only sold the policy once and so you were either mis-sold then or you weren't.

    That's good news.
I just got a letter from Santander for my claim going back a long way (for a policy sold through National & Provincial). It was just an acknowledgement of my claim, but at least it's being progressed.

I am confused as the letter says "If you claim compensation you will have cancelled your policy so you (and anyone else covered by the policy) will lose the benefits it provides"
So what about the premium I paid for this years cover?
Will I be offered a new policy?
    isn't that statement intimidating?
    What's the position?

However, there has been a subtle change in their wording from the original letters to that on the claim form.

The original letter stated "if you are entitled to and paid compensation you will have cancelled your policy...", whereas the claim letter states "if you claim compensation you will have cancelled your policy...". To me that says the very act of claiming effectively cancels your policy, whether or not they decide you are entitled to, and paid, compensation.

Today I got an acknowledgement from MBNA confirming they will investigate my complaint re 2003-2004 CPP premiums now. In their letter they also explain that post-Jan 2005 premiums are dealt with by the scheme of arrangement and ask me to contact the scheme if I haven't received a letter from them. (I've already sent my claim form to the scheme of course - and I checked by phone the other day that it had been received. Timescale of up to 8 weeks was reiterated. Saturday morning and around 8.30pm in the week seem to be good times to ring the CPP scheme hotline and not be on hold for long.)

Off topic, but I also received a cheque today for premium plus 8% p.a. interest in respect of a Sentinel card-protection policy on a Halifax credit card (one annual premium in 2002). This followed a brief phone call from Halifax to make me the offer, totalling £26.04 after tax. All done and dusted inside two weeks. I didn't even have to go into the reasons for mis-selling at any stage.

Don't spend it all at once!:D
  • I have had HSBC CardGuard since '95 and noticed that CPP 'took over' in 2005? I was under the impression that CPP were just taking over the policies and upgrading which I was paying a yearly premium for. I have recently found out (through letters sent to me) that CPP was in addition to the HSBC, I wasn't aware of this as it was not explained clearly, do I have a right to claim?

I have rung HSBC who said that my cards are covered for lost or stolen which is what I was aware of but it seems that CPP are charging me for things I didn't want or know about.

    Any advice greatly appreciated.

The CPP Redress Scheme covers HSBC CardGuard so if you think you were mis-sold then you should make a claim through this scheme. You can find their contact details at:
