  • I was sent a cheque for £73 back in April, but have only just got around to cashing it. However I was told the cheque has now expired (foolishly I hadn't realised this would happen). Does anyone know how I could get CPP to reissue the cheque?

    Same thing happened to me, no idea cheques had an expiration date, I know cheques can be refused by the bank if they're over 6 months old, but I found this on the cheque and credit website:

    "Is it true that cheques are only valid for six months?

    No. A cheque is valid for as long as the debt between the two parties (i.e. issuer and payee) exists. In other words, cheques don’t have an expiration date. However, it is common banking practice to reject cheques that are over six months old to protect the payer, in case the payment has been made another way or the cheque may have been lost or stolen.

    This timeframe is at the discretion of individual banks. It should not be assumed that cheques older than six months old would automatically be rejected – the only certain way to cancel a cheque is to request that a stop be placed on it. It is recommended that, if possible, customers in possession of cheques that are more than six months old obtain a replacement.

    Where there is a dispute, a cheque remains legally valid in order to prove a debt for a period of six years, which is the Statute of Limitations."




    No idea if this applies to CPP as well, I want to dispute this but not sure if it is a waste of time...

  • Hi there, I'm new to this and hope someone can help me.
    I work away from home and only recently found a letter with a cheque from CPP. I went to the bank to cash it but was told that the date was just over 6 months old. I sent the cheque back to CPP and explained the situation and asked to re-issue the cheque. Got letter back saying that are not able to issue a new cheque and in accordance with the terms of the scheme, your scheme claim has expired and no compensation is due under the scheme.
    I have phoned them up explaining that they still owe me money as I claimed within the time frame. They are refusing to send out a new cheque - any advice to get this lot to pay up ?
  • I got a check for £105 back in april. I have just looked at my Credit card statement and CPP Have charged me AGAIN for 36.99 Even though, after the settlement I had ticked the box to cancel all future payments. What should I do now?

    Hey all


    i've been arguing with CPP and the onbudsman now for a few months since the end August deadline


    Scenario - CPP paid me the refunds relating to the pre 2005 regulation period (about £26 as I joined in 2004) but refuse to pay me on the post period (£100's from many years membership) as they claim they never received a claim from me in time for August deadline - they have no despute on the liability (as they paid the pre-2005 refund )


    I have explained that


    1) I called many times in the period from Feb-August 2014 to get my form but they never sent it to me until the 30th August and it arrived after the deadline date (!?) although they now claim they did send it to me earlier in year (not what I was ever told by the call centre - they said if was all in a large admin backlog) - how can anyone prove I received it ? they sent them by normal mail (allegedly ??)


    2) I printed off a form (available here at MSE) and even sent that in during mid August as I was desperate - and guess what - that has never been received either !


    the problem is CPP are stonewalling me and the ombudsman is not responsible for enforcing the post 2005 activities - Great !


    asking a guilty organisation to arrange the refunds is like asking an alcoholic to hold the key to the booze cabinet - you know that no one else is going to get much of the product ! (as it seems has happened with CPP and the massive pot that didn't get paid out ??)


    if anyone else is in this situation I would be happy to hear .....and if anyone else has a suggestion as to further recourse ?

    I would recommend you take a long hard look on the history of this issue.............and then reconsider the statement above
  • I took out CPP on the advice of my bank in 2007. Two years ago I decided I didn't need it so cancelled, and thought no more about it. I then saw Martin's article just over a year ago so put in a claim to my bank. The bank investigated my claim and rejected it. They said this was their final decision, and as I have been ill for some time, pursuing this was not my highest priority. When Martin produced another article about this some months ago, I thought I would refer this to the Financial Ombudsman. The adjudicator dealing with this said that as it was over six months since I wrote to the bank she could not support my claim. She rang me up to discuss my case, and when she found I'd been ill and undergone major surgery she asked for a detailed timeline of my health problems that my GP kindled provided. On the strength of this she upheld my claim and I have just received £450. Many thanks Martin for drawing my attention to the situation with CPP in the first place.

    I've earlier described my successes on this thread with both CPP (post 2005) and NatWest (pre 2005).


    After more than 2 months of being sent around the houses at HMRC I've finally received a letter from them accepting my claim for a refund of the tax deducted on the interest element of each settlement.


    So, a hat-trick of results and the best part of £700 back where it belongs - in my pocket.


    Thank you, MSE, for giving me the platform upon which to share in my celebration of a rare victory for the little guy against the unscrupulous big corporations and the arrogant, faceless tax office.
