I share your instinct, JP. But I know that those of a more legal bent are sceptical - it's to do with the definition of a "flight" apparently, with a journey comprising several flights. There has to be a delay,as I understand it, with the EU part of the journey (the EU flight) for the Regulations to kick in. If the delay is entirely out of the EU area, then apparently the Regulation probably doesn't apply (even if the journey started in the EU).
But in SL travel's case I understand it was the EU orginating flight from Heathrow (like mine with KLM last month) that was delayed, resulting in an overall delay of 7 hours due to missed connection.
My KLM e-ticket very definitely states Leeds to Lyon, France so in my mind a single ticket. And my hastily booked BA return flight e-ticket states Paris to Leeds even though there was a change at Heathrow.
When I put in to the KLM or BA flight search an origin and destination, it gives a journey, whether that be direct or connecting. It shouldn't make a difference inr espect of 261/2004.

So what would be the result in an EU carrier flying the opposite way, into the EU with a flight change, the intial delayed less than 3/4 hours but the overall effect due to missed connection was more than 3/4 hours?

I think the argument would be that this was covered by the Regulation, as both flights were subject to 261/04 - even one wholly outside Europe.
  • Thank you for your excellent advice. After a 19 hour 44minutes delay with Thomsons we claimed. Thomsons rejected it but I contacted the Spanish address you gave as we flew from Menorca. They said we were entitled to 400 euro each. After several letters, emails and a phone call Thomsons sent us a cheque for £584.24 yipeeee many thanks :j:rotfl::money::T

Thank you MSE!!! After reading your column my brother and I followed your guide in full to request compensation for a delayed flight home last year from Portugal. Within 7 days, BA had acknowledged the complaint and agreed to €400 each for all eight of us travelling - success!! Just shame the xchange rate is good ; ) Thank you, it has paid for half of this year's trip!!
  • We have been getting the regular update emails from Monarch, having claimed for our delayed flight at the end of August.

We've just received an email to say we will receive compensation.

I know it has been a frustrating wait, but I guess patience paid off!

Thank you MSE for providing the tools to do this!

We have finally received €600 compensation from AF for a 5 hour delay on flight AF1980 on 6/8/14 from CDG to LHR. Our case was declined by AF on a number of occasions with the excuse about a foreign object on the runway and therefore 'extraordinary circumstances' before they closed the case. We continued the case through the UK ECC which has proven to be successful. Thanks for your assistance Martin as I would normally have given up after the initial request was turned down.

Just received the full €600 each for delay last July of 24hrs going to Washington via Reykjavik. Initially refused by Icelandair, appealed using Martins Letter to CAA. Thought wasn't going to happen as heard almost nothing since last sept then 2 emails saying thank you for patience about a month age followed by email saying success. Hang in in there, took almost 10 months from start to finish.
  • Received cheques in the post last week.

Claimed for flights to Hong Kong via Doha from July 2012. Delayed flight from Manchester meant a missed connection. Used the MSE template and Qatar initially knocked it back after 3 weeks wait quoting a technical fault. Emailed them back quoting the recent court judgement and asking for clarification about the technical fault and got a reply straight back saying they had reconsidered and were now paying 1800Euro! Money in bank within a week after we filled out forms. Thank you MSE!
