EU261 duty of care covers refreshments during delay irrespective of reason for delay. If you send in receipts these should be reimbursed

Your original flight details are irrelevent since a non EU airline leaving anon EU country.
However, if you had a valid ticket for an EU airline (BA), arrived at check in on time and were denied boarding then you should be due compensation under reg 261/2004. Denied boarding is far more difficult for airline to defend. You had a valid ticket, they chose to put somebody else in your seat. Simples.
Have you read Vauban's most excellent and informative guide? If not, do so and get your claim in.
Not sure I interpret it the same way.
The original flight with AA is, as you say, not a valid 261 claim, None EU etc.
However, the re routed flight on BA also doesn't qualify as firstly nothing was paid by the OP for the flight, it was free. Secondly, my opinion is also based on the accepted principal that the OP could not apply for a second amount of compensation if the first delayed flight was a valid claim. We were flying on one ticket Cardiff to Chicago with connecting flight in Dublin. Flight from Dublin to Chicago cancelled with 90 minutes notice. We were put up in a hotel and flew out 24 hours later.
We lost one night's accommodation in Chicago because it was too late to cancel.
I contacted Aer lingus (Facebook) and was told there was a technical fault. I completed the form supplied by MSE snd submitted. Contacted Aer lingus again for an updated and told to complete their form which I did and received a case number.
21 days later I messaged to ask what was happening and was told there was a 60 day delay (ironic) in reviewing claims. I asked what was the procedure for keeping me updated - response when we've reviewed it. Seems a long time to me.
My question is how look should it take? I haven't escalated the MSE Resolver complaint because I was told to do a separate one - should I?

I don't know if I have posted this in the right spot but in essence all I want to know is what my rights to compensation are if I booked with Opodo to fly with British Airlines and then I only find that the reservation (which still showed on BAs system) is voided. After protracted discussion, Opodo have booked flights with Lufthansa but the arrival time will be 4-5 hours later than anticipated.
I am assuming I can claim consequential costs such as food and taxi back to York from Manchester as it only arrives in Manchester at 2240. Am I entitled to any additional compensation as per Delayed Boarding Guidelines as the fault was undoubtedly Opodo and not BA (although one could argue BA were also at fault for not highlighting the problem when I logged on to their system).
Any advice on my rights would be most welcome. If this is the wrong place to post, I apologise and would ask if you can tell me how/where to post. Thanks0 -
you don't mention when you are due to travel
You made a booking with a 3rd party agent that has not a good reputation
they did not make the booking correctly so have now booked you a different flight
No claim from BA...they have not delayed you
Who do you plan to claim your consequential losses from? have Opodo actually said they will pay your taxi home? or are you hoping to claim from travel insurance?0 -
I am in the process of travelling today so it could yet get worse. I propose to recover the consequential lossss from Opodo - they have not agreed to anything and just suggested that I should make a complaint. The reason for a taxi is the time of night and the impractability of public transport at midnight. What I was interested to know is if Opodo would be liable for delay/compensation in the same way an airline is or not.0

In a word, no. You will probably have to sue Opodo for breach of contract etc.
I don't quite understand your original post. Are you saying that you had a reservation/booking with BA that you could log onto and confirm? Or that no such reservation/bookd flight actually existed, in that Opodo failed to action it??If you're new. read The FAQ and Vauban's Guide
