My claim was refused by Jet2 as they said the delay was due to a French ATC strike and outside their control. However, once on board there was a technical fault that meant we couldn't leave the gate - we sat there for almost two hours before it was resolved, then waited for another departure slot - delayed our arrival by over four hours.
Oh, and when we arrived we waited 20 mins with doors shut before we could get off - technical fault again.
Any advice as to whether this is worth pursuing further?

    Thanks
    Catherine

  • Hi, today my daughter's BA flight was delayed (chartered by Thomson). Just before the 3 hours delay approached the passengers were asked to board the plane. Once in their seats they were told they would have to wait in their sets for another hour and a half before the plane could take off. Can anyone let me know that as she was on the plane just before the 3 hour delay was up,but not in the air, is she still entitled to claim compensation for the delay? The staff at Alicante airport were very unhelpful and did not know the reason for the delay. On departing the plane, one of the doors could not be used so everyone had to leave through one door. Also at the luggage reclaim the carousel the luggage was on stopped working and the luggage had to be transferred onto another carousel, causing another delay on getting out of the airport!!

If delayed over 3 hours upon arrival then sounds like a valid claim. Compare actual arrival time with the scheduled arrival time. Departure time has no bearing whatsoever.
  • Has anyone had an airline agree to pay compensation and then not pay? I submitted a claim to Royal Air Maroc for a 6 hour delay, they agreed to pay via bank transfer and I haven't heard a thing from them since even though I have sent them countless emails. To say I'm miffed is an understatement.

This seems increasingly common especially with airlines not based in the UK. So it would really help if they had a UK address to send an NBA, issue Court proceedings and send in the bailiffs - and they do!

So read Vauban's guide - you have probably already done so - and either press on yourself or try a nwnf lawyer.

I am in a discussion with the airline. Clearly not willing to pay compensation.

My rerouted flight went from LHR to YVR to SEA.
In YVR, you have to cross the border to Canada, pick up luggage, and then cross the border to the US.
Only, my luggage was not on the plane, so I waited quite some time for the luggage which never came and ran out of time to catch the next plane.

Is the fact that my luggage missing for this transit, it entitles me to get a compensation for long flight delays?
    What do you think?
Should I take this to court?

I was rerouted because my first flight was delayed due to "airspace restrictions being in place", i.e. an extraordinary circumstance.

The June 10th 2016 EC261/2004 guidelines clearly states that:
Any new right to compensation according to Article 7 will apply to the re-routed flight accepted under Article 8(1)(b) or (c) if it is also cancelled or delayed at arrival (see Section 4.4.11).

Due to fly home from zante to EMA. The plane was delayed due to weather so the plane had to land in athens. We were due to fly at 13.45. The plane finally left athens and landed in zante around 18.00. Crew and passengers left the plane. We were not told that the flight had been cancelled until 21.30. The weather inproved and later flights landed and took off for the uk and europe. They told us that the crew had run out of hours so could not fly us home. They knew there was problems in the afternoon but never told us about it and kept promising that we woukd fly. They eventually found us hotel rooms at midnight and arranged pick up for 7am following morning. We eventually flew home at 10.30 this morning. We were given 1 sandwich amd 1 drink for the duration of the delay. We were kept hanging on on false promises.

My question is can the airline wriggle out of compensation as the weather caused the intial delay even tho the reason they coukdnt fly us home was that the staff actually ran out of hours. I thought that in these circumstances they fly out extra crew on other flights so that they can fly people home. I was on the understanding that TC do this so do Thomson not bother. 3 flights were affected by this. What are our rights regarding food and drink when delayed.

    Thank you
  • I know I was delayed both outbound from Manchester to sharm el sheik and inbound from sharm to Manchester. However all I can remember is the month and year. It was Feb 2011. Does anybody know how I can find out more details? I have tried flightstats but to be honest I'm not that good with technology and websites.
  • don't you know the airline?
