Wonder how many airlines will sign up?

"The CAA expects all airlines to sign up to a third-party alternative dispute resolution service (ADR) by June 1."
Yeh, we've seen this before and the airlines were not interested.
It just smacks of the CAA's desperation to rid itself of EU261 responsibility and all it involves, it's been a poisoned challis right from the start. Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -

Forget CAA, even if they find in your favour (unlikely - they are ultimately funded by the airlines), they cannot enforce their findings on the airline - it's merely an opinion.
Download Vauban's excellent guide & read it thoroughly...

Then either issue a LBA yourself directly to the airline or use a no-win, no-fee solicitor if you don't feel confident doing it yourself.
Post any further questions on the American Airlines thread & the regulars on this forum will help where we can.
Good luck.- - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -

Flight delays - Vauban's Guide has been of immense help - please read it before posting questions - I'll be surprised if your answers aren't in there.

I am sorry if it is explained elsewhere but I did not find an answer to my question, so posting it here.
My family were delayed leaving London for Charlotte (USA) in September 2014. From the email "The departure time for US Airways flight # 731 from London-Heathrow (LHR) to Charlotte-Douglas (CLT) on Monday, September 8, 2014 at 10:05 AM has changed. The flight is operating behind schedule due to aircraft maintenance. Your departure is now 3:55 PM. Please take a look at your updated flight information."
A month ago I have applied for compensation (using the template letter here) as discovered we could claim.
This is what I received today "Since flight 731 was delayed due to a lightning strike of the aircraft, American Airlines is not required to provide the compensation you have referred to."
How can I verify the reason for the delay was the lightening strike and not maintenance as was first indicated. Or is there anything else I should check?0 -
And just to clarify - US Airways was taken over by American Airlines, hence these two names mentioned.0

Does not matter if maintenance or lightning ...... both are not valid reason to say 'extraordinary circumstances'.

in addition to the advice from 111KAB below, AA are not factually correct. Flight 731 didn't take off on time, the lightning strike / delay had already taken place on a previous flight, therefore flight 731 was delayed due to maintenance / repairs following a lightning strike on a previous flight.
This makes it a 'knock-on' delay which, even if it were 'extraordinary circumstances (which as KAB pointed out it wasn't), AA can't use it to avoid paying.
Look up the Finnair judgement on Vauban's guide & use it in a LBA to the airline. You do have a valid claim.- - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -

Thank you both so much! I did read that guide but overlooked the Finnair case. Will now reply.

Another thing you could try to back-up your claim if needed;
Check your flight details on flightstats.com - you'll need to register in order to access the historical flight data.
Have a look to see if the information gives the actual aircraft registration number, then check US Airways / AA flights into Heathrow shortly before your scheduled departure time to see if you can find a delayed incoming flight for the same aircraft.
If the previous flight was on-time to it's schedule, chances are that will be the flight that suffered the strike causing #731 to be delayed. If the previous flight was also delayed departing, the strike may have happened earlier than the immediately previous flight & may take some more trial & error searching to find the flight that actually suffered the strike.- - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -
