Compensation for delayed flights Discussion Area

My application for Flight delay compensation has just been rejected by T.Cook - their reasoning is that they sub-contracted the Abdn - Dalaman flight to a Turkish company (which no passengers were aware of until we reached the Departure Lounge!) - the Flight Crew turned up over 3hours late
- my argument is that I paid THOMAS COOK for my flights (not Freebird Turkish Airlines) - surely my contract is with T.Cook and they are responsible for compensation?
- their 'out' is that Turkey is not yet an EU member so they don't want to know!
- should I proceed with a message to the Ombudsman to pursue this or am I wasting my energy?0 -
Thomas Cooks are correct, you can only claim against the actual airline but if it was the outbound flight from Aberdeen and the reason for the delay was under the control of the airline, then you may well have a claim. Send an email to info@freebirdairlines.com and remind them the law does apply to all airlines departing from EU airports and that if they refuse the claim you may suggest to the EU that Turkey is not admitted to the EU, not that I think that is the first thing on their minds right now!0

Good morning all
I heard on the radio this morning that passengers at Birmingham airport were being held up in security because of 'technical problems'. It was reported that many airlines were holding their flights to allow for this. One hopes people will get to their destinations without too much delay but I'll bet there will be missed connections and misery to follow. Now obviously this is beyond the airlines' control - so is there anyone else, such as the airport, to pursue?0 -
BUT the airlines do contract out these services to the airport, so presumably the whole sub-agent arguement could be used?If you're new. read The FAQ and Vauban's Guide

Just got a duper fast (contacted them 4 days ago) offer from Emirates.
I had a flight to Australia that was delayed to Dubai by 3.5 hours. Total delay to Oz was 8.5.
They have offered me 300 euros per person (for the Dubai flight) - which i am delighted with.
But i'm going to push back and ask for total delay which would be the next tier of compensation.
I assume they can't withdraw their first offer lol?
Thanks for the templates and advice on here. I can;t believe how quick and easy it was.0 -

They will fight you all the way, as that is their line the draw in the sand!
Shame it wasn't over 4 hours to save any further argument.
Good luck. Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -

How much should I be compensated for the below? I think EUR 400 because including the stop in Brussels the distance is >1500km. However the airline is claiming layovers are ignored, and that only the distance from origin to destination should be considered (<1500km -> EUR 250). What is correct?
Departure airport: Stockholm (BMA)
Layover via: Brussels (BRU)
Arrival airport: Manchester (MAN)
Scheduled departure time: 13:30
Scheduled arrival time: 17:00
Actual arrival time: 21:25
Total time arrival delayed by: 4:250 -
