    I have been told I will be getting compensation for a cancelled flight in 2011 but the childrens must be paid into a child trust fund or a junior ISA. Is this right and if so why as they didn't pay for the original flights, I did!!

    Never heard that before - probably just stalling again to keep the money earning interest in their account for longer. As far as I understand the Regulation simply refers to compensation being due to the passenger (don't lose sight of the fact that the law exists to ensure compensation is paid due to the inconvenience caused by the delay suffered to every affected passenger, not necessarily due to whoever paid for the tickets - for example a business traveler can claim personally if his employer buys the ticket etc...). Having said that our compensation (including the childrens) is going towards next years holiday, so ultimately the children are benefiting from it. I know the NWNF solicitors deal separately with each passenger in a party & issue separate payments (probably a rouse to try & justify [non-existent] transaction fees, but as long as a parent / guardian is receiving the payment for their child I don't see any issues. I'd suggest writing back & insisting it be paid to you on behalf of your children.

    April 2016 - successfully claimed €1600 from Thomas Cook for 6 hour delay in August 2015
    Old debt passed to collection agency? Issue CCA request & possibly have debt rendered unenforceable. Feb 2021 - £42 of old debt legally written off & cost £1 per account.

    I did 2 claims for my family. For the one that I made a small claim application for, even though that was settled without going to court, I had to attend a hearing and then pay the compensation for the under 18yo into the court.     For the other claim where the airline just paid out, they just sent me a cheque for the lot which I paid to the under 18's parent to invest for them.

    The money belongs to the child as a delayed passenger. Who paid for the ticket is not relevant.
  • Dear all,

    How do I calculate the distance when experiencing a delay when connecting flights? Using Great Circle Mapper, is it (A) the actual distance flown (including layover) or (B) only the distance from origin to destination (disregarding intermediate stops/layovers). I would imagine it is A, but the airline is claiming B. I can't find any clear language that intermediate stops should be ignored in the EU directive... any help would be much appreciated!

  • I am after a little bit of advice, I went on a package holiday with Thomas cook to Majorca in 2014 the flights where with Condor (Thomas Cooks German airline) the flight back was delayed more than 3 hours so I completed there compensation form under the EU 261 rule, Condor rejected my claim and when I emailed them back to ask why the flight had been delayed I got the reply that the claim was re looked into and rejected again which left me none the wiser as to the reason for the delay. I then took my case to the spannish regulator AESA who investigated the claim, according to their report Condor did not suply them with any infomation when requested to do so. The AESA concluded that it believes Condor should pay me 400 Euros per passenger and Condor has already accepted to compensate another passenger for the same incident. I then emailed Condor again to tell them AESA findings (which they where sent anyway by AESA) only to recieve a final email from Condor saying they rejected my claim and would not look into it again. Can any one give me advice how to file a claim against Condor as when I tried filling the Money claim online form it says the company has to have a UK poscode and although their parent company Thomas Cook has a UK address It doesnt seem as if Condor do..... Any adive please :)

    I was booked on a flight from Heathrow to Cape Town on 29 March. An hour into the flight, 2 fuel generators failed and the plane eventually returned to Heathrow. The passengers were put up in a hotel and given meal vouchers before flying out the next day. BA then lost my luggage for which I have submitted a claim for cost of the replacement items, but am I entitled to compensation for the delay per se?

    If you can answer YES to all the questions under section 2 then your answer is Yes, you can claim under EU 261/2004.

    From your question, it was British Airways out of Heathrow, in which case it's YES.

    For a flight of 9693 km you should be entitled to €600 for a delay of 4 hours or more.
