  • Three of us taking Aer Lingus flight EI3601 from Manchester to Shannon on June 15th 2013 due to depart at 0900. We boarded and after several hours in the plane the flight was cancelled and we were offered, and took, a Dublin flight departing around 1700 the same day. No food, drink was provided. I need the number of the Dublin flight to complete my compensation claim, can anyone help with this please and maybe advise me on my claim. Thank you.

    Which airline did you fly to back to Dublin with? What did they say was the cause of the earlier cancellation?

    According to the Flightstats website, there were a number of flights to Dublin from Manchester on 15-06-2013, but none listed as departing around 17:00. Assuming you still flew with Aer Lingus, Flight 209 looks the most likely.

    With regard to your claim, if you haven't already done so, download & read Vauban's guide & issue a NBA to Aer Lingus as soon as possible. There is no reason shown on Flightstats for the delay & if they didn't give you a reason at the time you have nothing to work with at present. Best to put in your notice & see what they come back with.

    Flight delays - Vauban's Guide has been of immense help - please read it before posting questions - I'll be surprised if your answers aren't in there.
    April 2016 - successfully claimed €1600 from Thomas Cook for 6 hour delay in August 2015
    Old debt passed to collection agency? Issue CCA request & possibly have debt rendered unenforceable. Feb 2021 - £42 of old debt legally written off & cost £1 per account.

    My son and his partner were delayed over 6/7 hours returning from Bangkok to Birmingham airport travelling on an Emirates airplane. I helped them claim for compensation, initially thinking the EU Regs. applied. But worryingly, while you can claim if the non-EU airliner leaves an EU airport, you cannot if the same type of plane lands at an EU airport!! What are those EU lawmakers thinking? No reasoning given for this inconsistency.


    However, they did say to Emirates that if they did not qualify under the EU Regs. then the claim is made under the contract with which they bought the tickets. My understanding is they can get a full refund. Emirates replied 4 times saying they did not qualify under the EU regs. and my son replied 4 times they were not claiming under those Regs. but were claiming under the contract. To me this delaying/dismissive tactic by Emirates proves they have a valid claim under the contract. Otherwise they would say if it was not valid under the contract!


    To the Regulator now, and if necessary, the small claims court. Moral is don't fly Emirates!

    I flew etihad on a staff ticket and the flight was cancelled.. They did offer a hotel and taxi service for one night but no money compensation (probably because nobody really complained).

    I was just wondering if all these rules apply to staff tickets too (i personally dont work for the airline, just used one of my friends yearly ticket allowances)..??

    The regulation shall not apply to passengers travelling free of charge or at a reduced fare not available directly or indirectly to the public.

    To BaldacchinoR, I think you have been misinformed, the time of arrival is not a contractual term in any airline contract, they only promise to get you from A to B, possibly via XY and Z and that is it. The Regulator is the CAA but the general view is that they are a complete waste of time, and in any event they can only investigate departures from UK airports.

    Sue by all means but there is no breach of contract and Emirates always defend in court and there is certainly no EU261 claim. Next time make sure they book with an EU based airline, when the rules apply outbound and return.
  • hi there me and my partner were delayed from palma to glasgow on saturday night were cancelled were put up in a hotel and were told our flight was 1545 the next day it was given a diffferent flight no and did not take off till past the 3 hours the reason was the plane diverted to toulouse because a astag party were causing havoc on the outward journey and the crew had run out of time do you think we are due anything from this

    Yes you are due €400 each. The problem on the plane happened on a previous flight and is classed as a knock on effect. Google Vaubans guide and read it and go from there all explained in the guide.

    where in the Emirates condition of carriage does it say they will issue a refund for flight delays?
    Emirates may choose to give some miles for delays but I am not sure why they would refund a flight ticket that was actually used

    If you choose to avoid any airline that does not give refunds/compensation in the case of delays outside the EU, you will need to avoid all non-EU airlines, not just Emirates
