Many thanks to JPears and NoviceAngel. To try to sum up it was within 6 years i.e. July 2009 and we did get a refund on the ticket (£60) so I'm OK on that front. But the regs quoted do not seem to specify if you have to take the return flight with the original carrier.
Right to reimbursement or re-routing
1. Where reference is made to this Article, passengers shall
be offered the choice between:
(a) — reimbursement within seven days, by the means
provided for in Article 7(3), of the full cost of the ticket
at the price at which it was bought, for the part or
parts of the journey not made, and for the part or parts
already made if the flight is no longer serving any
purpose in relation to the passenger's original travel
plan, together with, when relevant,
— a return flight to the first point of departure, at the
earliest opportunity;
As I mentioned there was nobody from EasyJet present for the entirety of the episode while my wife was there so she couldn't check and when I looked online there were no available flights the following day - as such the earliest opportunity with EasyJet would have been the day after that.
Sadly I think this will fail as the originating country was Germany and when we tried last time with their national body they really didn't seem like they wanted to help. However, hope springs eternal and with the new rulings things may be different.
I'll go back to EasyJet with the quoted regulation and see what excuse they come up with next.
PS. In my original post the crucial word missing was 'decided NOT to take the flight'. Duh.0 -
The German NEB is irrelevant for your claim.
Write to Easyjet and if they don't play ball, don't mess about - send an NBA and then take them to court (or get a good NWNF firm like Botts to do so).

the retrun flight bit is more to do with connecting flights ie your first flight is late, missed connection departure and then delayed by this for more than 5 hours, they have to provide you with a flight back to where you started, for nowt. Which could be useful if you can get a better alternative flightIf you're new. read The FAQ and Vauban's Guide

I have read REGULATION (EC) No 261/2004 and in Article 6 (Delays) there is no right to get a compensation mentioned in Article 7. I think you're not entitled to get any EUR compensation. You can have drink and meal and hotel as is written in Article 9 and cost refunded as written in Article 8. But nothing about Article 70

I don't know what I could claim in the following scenario:
I was due to fly from A to B with Airline 1 then 4 hours later from B to C with Airline 2.
The first airline's plane was delayed first by fog and then by a technical fault so airline 1 had to get another plane to fly from A to B. I had no way of connecting with flight B to C.
The flight was due to depart A @ 11:40 but arrived in B @ 18:04. Journey time of 70mins.
Whilst at my origination airport I had to book another return flight directly from A to C for the next day which was quite expensive.
I was unable to use my return flights A to B or my return flights B to C. I also lost my transfers and a night in my hotel.
What claim can I make against Airline 1?

llanman - suggest you are more specific but just with actual airline/route/delay in hours re arrival and post on appropriate airline thread after reading Vauban's guide.0
