What claim can I make against Airline 1?
were your flight tickets from A to B and B to C on one ticket or separate tickets?
(I am assuming separate as otherwise the airline would have been able to reroute you A to C with no additional cost to you)
At what point did you abandon the A to B flight to book another flight?
Once a flight is delayed for 5 hours (arrival time) you have the ability to claim compensation plus a refund of the ticket if you choose not to travel but only if the delay is within the airlines' control. How much of the delay was due to the fog?
If not possible to claim from the airline the other option will be your travel insurance0 -
I have read REGULATION (EC) No 261/2004 and in Article 6 (Delays) there is no right to get a compensation mentioned in Article 7. I think you're not entitled to get any EUR compensation. You can have drink and meal and hotel as is written in Article 9 and cost refunded as written in Article 8. But nothing about Article 7
You are right - but also wrong!
The Regulations don't stipulate compensation for delayed flights (unless you are re-routed I think). But the European Court subsequently (in the Sturgeon case) ruled that a delay of three hours should be treated as the same as a cancellation for the purposes of the Regulation. Hence the entitlement.0 -

I've never been to either A, B or C - though I hear the beaches are nice at B. Personally I never choose to fly with Airline 2 - their in-flight catering is terrible.0 -

The flights were with different airlines and therefore were on different tickets.
The plane I was supposed to be on completes 2 flights before it reaches Cardiff. The first flight was delayed by fog in Newcastle for 108 minutes. On reaching Dublin it develops a technical fault. A replcement plane is sent to Cardiff when available. It leaves Cardiff @16:55 and lands @18.03.
I abandon the flight @14:30 when I purchased a new flight. I could see no way to reach my destination in time.
My connecting flight was due to leave Dublin @ 16:30.
I had no insurance.

From the information you have provided, eg weather did not directly affect your flight and was on a previous sector, you could qualify for €250 compensation and refund of the ticket. At what point did you advise the airline you were making your own arrangements? - this could be the sticking point if this happened before it was known it would be 5 hour+ delay0 -
The German NEB is irrelevant for your claim.
Write to Easyjet and if they don't play ball, don't mess about - send an NBA and then take them to court (or get a good NWNF firm like Botts to do so).

Thanks for the guide. It is very clear and informative with great advice on what to put in correspondence with airline companies. Having read the process on going to court and seeing your scarily long list of bundled documents I suspect that airlines are happy to let it go that far as most people would be put off. I'm not sure I would have the time to do this so would probably opt for a NWNF firm - what sort of fee do they usually charge?0 -

I didn't advise them. I just removed myself from the flight when I knew I couldn't make my connection @ 14:30.
We check the next day's flights but they were all full and there was an Air traffic controllers strike. So I could see no other option other than to purchase.

A Big Thank you to everyone who has posted help and advice on this forum.
My husband and I were delayed when travelling to our honeymoon in Cape Verde in 2013 with Thomson Airlines by over 7 hours.
The reason given was a warning light had come on in the cockpit. We sat on the plane for 3 1/2 hours before being asked to disembark to await a replacement plane.
I initially wrote to Thomson as per this thread in Sept 2013 seeking compensation, but this was turned down as it was claimed by Thomson that it was "extraordinary circumstances". Following the Court ruling in October I decided to try again. I followed the link to the CAA website which said to write again to Thomson and template wording was supplied so I wrote again in February.
Today I have received a cheque for £873.53 from Thomson.
It just shows for the price of 2 stamps and a little time it is worth it. :beer:0 -
