  • My flight with Thomas Cook was delayed from Manchester to Dalaman in 2008 however i am having trouble finding out how long it was delayed. Ive tried using the FlightStats link but they were unable to find the flight. Are there any other ways of finding out if a flight was delayed??? Can anyone help???

    I think it's irrelevant because you're out of time (more than six years so can't go to court).

  • Just wanted to say a big thankyou to Martin and the team. The guidance and letter templates on your website have helped me secure 600 euros per person (1800 in total) for a 4hr+ delay sufffered with Monarch (flight MON307 Manchester to Sanford Orlando 17/09/14). Kept getting fobbed off and being told to wait for six weeks at a time but just patiently chipped away at them. Had to escalte to the CAA in February of this year (thanks again for the links to their site) they were very helpful and no doubt speeded up the resolution process.

  • Thanks for the feedback. I've read on here that you can claim back to 2005, I know it's generally more difficult but still possible. Is it not work me trying

    This is EU law and the time limits for bringing action will differ with different countries
    In England and Wales this is 6 years, in Scotland it is 5 years
    Any airline can safely reject your claim or ignore you, safe in the knowledge that you are too late to take any action

    As others have told you Over six years = No claim

    Although I do have a little sympathy because MSE's advice is somewhat misleading IMHO.

  • Thanks everyone for all you advice. Feeling a bit deflated because I tried to complain about the loss of my first days holiday at the time and was fobbed off. Seems the new ruling came a bit late for me.�� thanks again using this forum has been helpful.

    So I finally got a written NO from Thomson.

    Basically they state that the crew delay was caused by their connecting flight being cancelled. They then state that this could not be avoided even if reasonable measures had been taken and that its also unreasonable to have standby crew in every overseas airport.

    Therefore circumstances are extraordinary in accordance with article 7 blah blah blah...

    So even though it states here crew out of hours is avoidable and not extraordinary the airline say otherwise.

    Surely flight delays happen frequency enough so are avoidable with correct procedures for alternate contingency options?

    I'm not sure if i should try the CAA next or what!!?

    Does anyone have any experience of compensation (successful or otherwise) caused by crew delays due to a cancelled connecting flight?

    the CAA don't get involved generally. Besides the outburst at the weekend they are pretty much useless. Also they won't get involved in helping infividuals.

    if you want to pursue it ask Bott and co for their opinion.
