    They are trying to interpret the regs, incorrectly IMHO, to their advantage.

    Quoting the Folkerts ruling had the desired effect, I didn't hear anything else from them until I chased again a month afterwards at which point they agreed to pay, which they promptly did.

    Just got that one out of the way and I ended up with a 17 hour delay London to Hong Kong courtesy of Swissair, so here we go again..... I think this one could be more of a struggle though as not only have Swissair quoted "exceptional circumstances", but they're refusing to tell me what those circumstances are!

    Really, 'more of a struggle' well it will be if they went belly up in 2002?? Otherwise take them to Court, and enjoy your compensation....

    Doesn't matter if they don't tell you what 'exceptional circumstances' there were as they do not count. Only extraordinary circumstances can relieve an airline of its obligation to pay compensation.

    Send them an NBA and don't forget to (have a read of first) refer to Pre Action Conduct Protocol (particularly Section II 4.4 (1)) and that you will bring their non-disclosure to the attention of the Judge when you get to court.

    The above is just my opinon - which counts for nowt! You must make up your own mind.

    Just had my email through to say that we have been given the full compensation of €1200 (€600 each). Well chuffed!

    Our flight was delayed by about 24 hours from Toronto to London back in May 2014. I just copied Martin's template and it took about a week.

    After reading your last few posts, and in the threads they've been in, by all means take a break, but we upstarts like me, still heavily rely on the forum experts, with an encyclopaedia of knowledge that us mere junior posters aspire to....
