    I have not seen any posts of any airlines paying out post the small claims cutoff......if the airline knows they can ignore you or reject your claim and there is nothing you can do and nobody than can make them pay you......do you really think they will send you money? (it has been hard enough for people with valid claims to get compensation without resorting to court)
  • Hi there,

    Has anyone else had any experience with connecting flights?
    I had a connecting flight with United Airlines (at the time it was 'Continental') from London to Chicago via New York.
    I booked the flight for London to Chicago, however, it meant a stopover and changing planes in Newark.

    The plane was delayed at Heathrow due to a technical fault. I got to Newark late and missed my connecting flight. At the time I was given no food tokens, no hotel room and spent the night in the airport lounge.

    I wrote to United, they offered a travel voucher. I wrote to the CAA, and they said that they agree with me that United are at fault, but that United are refusing to pay because it was missing a connecting flight that meant that I was over 6 hours late to my destination.

    The CAA recommended me that I could take court action. I wrote to United and stated this, they stood to their point and refused again.

    I'm going to go ahead and take court action and wondered if anyone else had any experience with connections and any advice?

  • Hello, my flight from Manchester to Gothenburg was delayed by 9 hours due to a technical fault in March 2011. We boarded the plane, and basically it wouldn't start. Easyjet offered us a refund after a couple of hours delay, which we accepted.

    I have submitted a claim for compensation to Easyjet, but they've turned it down as we received a refund of the cost of the flights.

    My understanding is that a refund is to be treated separately from compensation. Are there any bits of legislation that I can quote to them, or is my perception wrong?

    Thanks in advance for any help in this matter.:money:

  • Apologies if this has already been covered but I have just learned that my cancelled flight with Monarch in 2010 is not covered by EC Regulation 261/2004. See the following extract:


    "6. Application of this Regulation to Gibraltar airport is understood to be without prejudice to the respective legal positions of the Kingdom of Spain and the United Kingdom of Great Britain and Northern Ireland with regard to the dispute over sovereignty over the territory in which the airport is situated.


    7. Application of this Regulation to Gibraltar airport shall be suspended until the arrangements included in the Joint Declaration made by the Foreign Ministers of the Kingdom of Spain and the United Kingdom of Great Britain and Northern Ireland on 2 December 1987 enters into operation. The Governments of Spain and of the United Kingdom shall inform the Council of the date of entry into operation"


    In future I will use Malaga airport - the ongoing journey may be a little longer but at least I know I will be covered for any delays/cancellations etc.

    Betterlate, elcome back. I assume from the above you managed to pinpoint the flight details/date?
    The above, IMHO, is b*****s from Monarch. Your flight was with a EU carrier, from an EU airport, into an EU airport so it is covered under 261/2004. But if others know better, I stand to be corrected.

    Gibraltar may not count as a EU airport for the purposes of the Regulation, but surely the Regulation still applies by dint of the other criteria - ie an airline leaving a European airport for Gibraltar or a European airline flying into a European airport from Gibraltar.
