Can anyone tell me if you can claim from the travel company for a 20 and a half hour delay and your own insurance for the delay:)

you can make a claim for EU compensation from the airline assuming it was an EU airline or a flight departing from the EU (whether anything is due will depend on the reason for the delay)
You can also claim from your insurance

You can claim for a delay over 3 hours from the airline responsible AND your insurance company.

Princesspower, are you sure it was Olympic as I do not recall them operating charter flights even in their darkest hours, and they had many of them. The flight number must have been OA......

I really can't remember the flight numbers did start OAI though.

Thank you to the members who gave me links to Olympic web site. I have already done the email contact form route and only received an auto response back which was over a week ago.
  • The flight number was OAI...
I can't recall who we flew with eventually out of manchester, but on the return it was definately Olympic as I remember the logo on the tail.
  • Thank you - but I have already been on their website and emailed via the link - the only response was an auto reply which was over a week ago :/

It's interesting to note that, from reports on here, a number of airlines are still paying out for delays over two years ago and those caused by technical problems - despite the appeals over Dawson and Huzar respectively.

I wonder whether the balance of advantage lies in starting a legal claim regardless - as it will force the airline to defend (and generally it's not a game worth the candle for them). What do others think?

Good-o: I would just hate to see you turned over by a smart airline lawyer because you hadn't done your homework!

Hopefully you've seen this too: http://db.orangedox.com/GdfSa4xUZdZI5GJadr/Vauban's%20Guide%20to%20Claiming%20Flight%20Delay%20Compensation.pdf

Just a little update on my case, unfortunately the CAA have ruled that the weather the previous day to our flight does count as extraordinary circumstances to our delay. Obviously they are not considering the 'knock on'. Now I know that everyone on here thinks the CAA are a waste of space and I'm now inclined to agree.

United have said they are defending the case, however they haven't sent back their directions questionnaire and the court have sent them an unless notice giving them another week to do so. They have also come back quoting the CAA ruling with a better offer in vouchers (still no good to me!) I have politely told them that we still feel entitled to compensation and will be continuing with court action, but wondered how the CAA ruling will affect our case in court?

    Any advice muchly appreciated

The short, blunt and unwelcome advice is that the CAA "ruling" is potentially very damaging to your case - if a district judge regards them as authoratitive.

Why did you write to them, when the clear advice on this forum is to stay well clear? They are no one but the airlines, friend.

Because that's what the guide to claiming on the main site says to do!! Everywhere States that it's important to follow the correct protocol and I believe the caa is no 4 on martins guide - maybe this should be changed? It was months ago that I contacted them - before I started thinking about legal action and therefore reading this forum.
