Compensation for delayed flights Discussion Area

I therefore think that our delay was due to poor planning and organisation and not just the technical fault. I'm not sure if I am right in thinking this and if I am, how to go about it.
There's nothing in your case which isn't dealt with in FAQs, etc.. If you want to take legal action, expect to be told your case is on hold pending the outcome of the Huzar appeal.0 -
Hi, my Orlando-Gatwick flight (dep 20.05)was cancelled less than 24hrs before take-off, ba rerouted me departing from Tampa(18.15), 2hrs earlier than my original flight, luckily I had a hire car, (90 mile drive,) but lost at least 1/2 a day of my holiday, by having to phone GB, (mobile had no reception and laptop would not let me rebook flights,) so phonecard, petrol etc. was bought, then when in GB, had to reroute ongoing travel from London Gatwick. I think I should be entitled to remuneration of some kind.
Does anyone have similar !?
Thank you
Have just received compensation from Ba, less than £35, just about covers the petrol! not happy!!0 -

I think this is covered in the table in section 5 here http://www.moneysavingexpert.com/travel/flight-delays#cancelrules
The actual wording in the regulations (that excludes compensation being due) says
(iii) they are informed of the cancellation less than seven
days before the scheduled time of departure and are
offered re-routing, allowing them to depart no more
than one hour before the scheduled time of departure
and to reach their final destination less than two hours
after the scheduled time of arrival
Whilst you may have arrived less than two hours after the scheduled time, you did depart more than one hour before
I read this as €300 but I may have misinterpreted it
(obviously this depends on the reason for the cancellation)0 -
No, that is a completely new one on me. Wish I could help.
I think this is pretty straightforward, unless I am missing something (entirely possible!).
The Regulation says in Article 5 that in the event of a cancellation of a flight the passengers is entitled to the usual compensation unless(iii) they are informed of the cancellation less than seven days before the scheduled time of departure and are offered re-routing, allowing them to depart no more than one hour before the scheduled time of departure and to reach their final destination less than two hours after the scheduled time of arrival.
So if your rerouted plane left two hours earlier than planned, you are entitled to compensation.
You are also entitled to the costs of getting to your original destination, if this is applicable. Article 8 (3) says:3. When, in the case where a town, city or region is served by several airports, an operating air carrier offers a passenger a flight to an airport alternative to that for which the booking was made, the operating air carrier shall bear the cost of transferring the passenger from that alternative airport either to that for which the booking was made, or to another close-by destination agreed with the passenger.
EDIT: Caz beat me to it! And Caz is also right, I think, about the reduction of the compensation from 600 euros to 300.0 -

If you mean that the delayed flight was in May 2008 then you are out of time - you need to have started court proceedings within 6 years0 -
