Compensation for delayed flights Discussion Area

Hi all,
First post on this website. I was on EasyJet flight 187 from London Luton to Belfast International on 4th Sept 2014. The flight was delayed almost 4 hours. On the plane the pilot said that they were in Italy flying to France iirc and they had to make an unscheduled flight back to Italy. Easy Jet sent an email the next day apologizing saying that it was due to bad weather. I don't recall the pilot saying this and didn't see any reports on the weather when searching during my 4 hour delay.
Any help would be greatly appreciated. I hope Easy Jet aren't just saying it was down to bad weather to get out of it.
Thanks
Worth a good read here (thanks to Vauban) https://www.dropbox.com/s/w6hmpy5ysxpck6k/Vauban%27s%20Guide%20to%20Claiming%20Flight%20Delay%20Compensation.pdf?dl=0

Hello: I thought I'd let people know about my good experience with claiming compensation from United. It was for a flight that me and six other members of my family took from London to New York in October 2008 with Continental (now bought out by United). We arrived 3.5 hours late and inconvenienced 10 other family members and friends we were flying in to meet up with. Others were flying in from Japan, the UK and the US and, as I was the main organiser, the fact that I was last to arrive was worrying and very inconvenient for the others.
I used the link on MSE to check the official delay length, then I used Martin's letter template. I found the original email confirmation of the booking with the booking reference still in my email account.
Continental no longer exist so I went to the United website and found an online contact form for Customer Services, which I completed and was able to upload the letter. I received an immediate auto acknowledge email. Then about a month later I received an email from United advising they accepted the claim for all 7 of us and provided a short form for each of us to complete with personal contact details etc. As an alternative to the €600 statutory compensation they offered $1000 credit in a United account to use on any flight. Some of us accepted this as they were planning to return to New York this autumn and this has covered the entire return flight fare. Those of us who took the €600 have just received pre-loaded Visa cards with £481 credit on them.
So, quick and easy. No arguments from United. Very polite and friendly email correspondence with them.0 -
Hi all. I have joined to see if anybody can clarify this for me. I have recently submitted a claim to Thomas Cook for compensation and costs due to an 18 hour delay and missing a connecting flight. They have agreed to pay £1311 final settlement which is purely the equivilent value of 4 x €400, however are insisting that this is all they are paying. I am out £1200 due to accomodation and new flights and possibly I am reading incorrectly but I thought I was entitled to both compensation and costs. Please help as my insurance will only cover up to £700 if I can even claim, given the 6 weeks I have been waiting to hear from Thomas Cook. Many thanks in advance.0

Was the accommodation cost whilst you were waiting for the delayed flight to depart, if so then that is claimable (they should have provided you with accommodation)
I assume the missed connecting flight was on a separate ticket. If so Thomas Cook is correct. Compensation is a fixed amount and the airlines are not responsible for consequential losses so you should be looking to reclaim these from your insurance.
You say you are "out £1200", does that mean you spent £2,511 on the flights and accommodation?
The FAQs are the place to start and the Thomas Cook thread is here https://forums.moneysavingexpert.com/discussion/43846930 -
Hi Caz3121,
Many thanks for info.
What actually happened was we got to the airport in Turkey to be told that we would not be flying that night so we were put in accomodation overnight. We flew back to Gatwick the next day however we had missed our onward flight to Belfast. By the time we passed through baggage reclaim we had missed all flights back to Belfast so we had to pay for new flights the next day and accomodation overnight in Gatwick which was nearly £1000. We also had to by dinner, breakfast and lunch for 4 bringing the total up to just under £1200.
Also we were given info at the airport that states -Flight delays over 5 hours
Flight only passengers. For delays in excess of 5 hours, you will be entitled to the above however, you may instead choose to have a refund of your airfare at the price you paid for your air ticket. Additionally, where relevent, we will offer a reurn flight to your first point of departure.
My reading of this is that I can get a refund on my flight back from Turkey???
Thanks again0 -

EU261/2004 does state that you can receive a refund in addition to the compensation where the flight is delayed over 5 hours, however this is the case where you do not actually take the flight - eg cases where someone going somewhere on a particular day and finds flight is over 5 hours late for a reason within the airlines control
choices
either wait for the flight booked on and receive EU compensation
or decide not to travel and receive EU compensation plus a refund of the flight
Your separate flight tickets may be covered by your travel insurance (alas this is the risk of flying on separate flights....I have separate tickets next month and am not looking forward to 7 hours in Gatwick as I did not want to risk a 2 hour connection - I have 4 days on the return so hopefully should be fine!)
Once you arrived back in Gatwick the contract with TC ended so hotel there will be down to travel insurance too
Well done on getting TC to pay up so quick...you will see from the thread many others have been battling for months
At the moment you have paid out £1,200 and received £1,300+ back so anything from the insurance would be a bonus. If your journey was ending at Gatwick you would have the benefit of the full compensation but the separate journey means that you may lose some of that depending what your travel insurance will cover0 -
It is the rule under EU Regulation that if your flight get delayed for more than 3 years then you are entitled for full compensation per passenger from airlines. To escape from this, airlines make such nonsense excuses that it let not to pay to its customer. Now it seems like you must proceed to the legitimate action against said airlines.0

Yes. If my flight was delayed by three years, I'd proceed to legitimate action too.0 -
