No wind up, airline was XL.com
They went bust in October 2008
They used to sponsor West Ham if any of you can remember

    Fleetman

The reason I believed this was a wind up is you mention some items which are very clear in the FAQs

    Airline bust= no claim
The claim is against the airline, not the travel agent, not the package holiday company, not the administrator, nor anyone else. AIRLINE ONLY. If the airline is bust, you have no-one to claim against. It doesn't matter if the package tour operator is still in business and the airline is not. No airline = no claim.

Small claims time limit 6 years in England & Wales, 5 years in Scotland

Not only do you not have anyone to claim against but, even if you did, you are out of time....it is all linked in the "Flight Delay Compensation Important Info - Please check before posting" thread

I think the post must be a wind up...only missing that the delay was due to weather!

Caz3121 - Is the thanks for Fleetman's post a wind up too or just some kind of irony?
The above is just my opinon - which counts for nowt! You must make up your own mind.
  • Have just received compensation cheque from Easyjetqueasy :j it took 9 months of research, delay, and navigating the English county court system- but for £1500 it is worth it. just watch out for the tactic of them intending to defend, before they cave in. I dare say that if all 200 passengers had claimed the business model of these airlines would be disrupted, or they could simply make sure they provide an aircraft in future.

I flew to Athens on the 24.04.14 and the flight was delayed by 5 hours. I have sent the Martin Lewis's template letter requesting compensation and this is Easyjets reply.

"Your flights was delayed due to technical issue in the aircraft which is considered as an extraordinary reason, which is beyond our control. Thus, I am unable to process any refund for the flights from London Gatwick to Athens on 24th of April, 2014 as per Regulation EU 261/2004."

    Can anyone help.

I have just joined the forum and I am very interested to see that you have won compensation from Easyjet [Well done]. Have you seen my posting?

If you read the FAQs and the EasyJet thread the answers are there. If you don't want to do that, contact a no win no fee firm.

I assume you asked for compensation rather than the refund that they refer to.

Well it depends what that technical issue was- if they failed to provide an aircraft at all,as in my case, it is worth persevering. If you want to go to summary procedure to recover the money, you should apply to the Court Tribunal Service in Salford (there are forms on line to fill in and a court fee of £80 that you can add to your claim). If your technical issue is one that is invalidated by the 261/2004 regulation then once they sniff the legal process, they'll cave.
