I have just read through 261/2004 and 'Air traffic controller, strikes is covered as a defence under extraordinary circumstances. It does not mention an internal strike. As I believe in this case not all flights with Lufthansa were cancelled so they could have appointed pilots to other flights. Some flights were cancelled others were not meaning we were discriminated against in this respect.
Also in our circumstances they did not do anything constructive to put us on an alternative flight and I had to take matters to my own hands, including an 80 miles round trip to the airport to sort things out. The available flights nearest to our original departure times were already fully booked and the alternative we opted for was the earliest available and the only one left on our departure date. If we had not have taken this flights on the subsequent dates would obviously have been booked up as well so we in effect had no choice to accept (as we already had return flights paid for) and we had no means of contacting Lufthansa who's admin were on the verge of melt down according to the staff member at Manchester Airport.0 -
In 2008 our flight from Cork to Birmingham was cancelled with no support available at the airport and no information as to why the flight had been cancelled (BMI Baby). This meant that we had to stay in Cork for an extra night incurring various costs. We lost out on 1 day A/L etc and we ended up flying back to Manchester the next day, hiring a car to get to Birmingham to collect our car which was at the airport. I wrote to BMI a couple of months later and they reimbursed the cost of the car hire but not petrol or extra car park charges and certainly no compensation offered. They said that the flight was cancelled due to bad weather but we obtained the flight data for the night in question and all other flights left Birmingham and arrived and departed from Cork on time so is it possible that they are not telling the truth and is it still worth chasing compensation?0

Anyway, if you read the FAQs you'll be better informed. You've 6 years from the date of the flight to bring legal action so if it was April 2008 or earlier, you are out of time.0 -
It depends when in 2008 this happened as the time limit for commencing court proceedings is 6 years maximum (or 2 years if Thomson win their appeal). I suspect that, regardless of the time limit, you might have to work hard to pursue a claim after all this time.0

Submitted a claim this year when I found out about the flight delay compensation, experienced a 13 hour delay back in 2011 with Thomsons. Done everything suggested on the wonderful 'Martin Lewis' website to try to claim compensation from them but they are simply saying 'Too late' 'By law we only go back 2 years' I know the website is telling me this is not try but how do I get that through to Thomsons????0

Done everything suggested on the wonderful 'Martin Lewis' website to try to claim compensation from them but they are simply saying 'Too late' 'By law we only go back 2 years'
I know the website is telling me this is not try but how do I get that through to Thomsons????
You don't, if you read the FAQs or search "Dawson", you will see that the 2 year argument is being heard in a case next month. The decision should confirm that 6 years is the time limit.0 -
