    You're quite right - I was confusing Domsta with Morgana. Doesn't help you much though, I'm afraid.

    Classic unfair reasons for rejection:

    Some firms, in particular Thomson, are citing the Warsaw and Montreal Conventions, which they claim state they don't need to look back as far as 2005. That's nonsense, the rules say you can go back to 2005.
    Some airlines say they'll only look at complaints going back six years. While this is unfair, you'll struggle to successfully claim pre-2007 because courts in most of the UK can only go back six years (five in Scotland), so it is difficult to enforce the rules back to 2005.

    The regulation allows you to claim back to 2005. But if the airline says "no", then English law only allows you to bring a court case for an incident that happened less than six years ago. Knowing you have no legal recourse, the airlines can confidently dismiss your claim.

    Had a flight recently with BA that was delayed over 3 hours due to an aileron issue which is being defended by the airline as EOC. From forum searches, there doesn't seem to be much success relating to this particular fault. Would appreciate the thoughts of other forum members as sending off a an LBA as next step.

    Ah, ok, thanks. I couldn't understand the fact that I'd seen that I could go back to 2005. But I understand now :D:T lol
  • Hi all newbie here, just watched BBC watchdog and I'm sure I heard them say " if your delayed from a non eu country but are landing in an eu country, your entitled to claim compensation"? We were delayed over ten hours, and were finally told on the flight home by the captain that our original aircraft had broken down. Are we able to make a claim?
