  • No I was supposedly within BA "care" throughout. We were Q-ing for 4 hours, we were told that accommodation would be sorted - it wasnt. We had to get taxis from Heathrow to Gatwick then trawl round numerous hotels until we got a vacancy - horrendous! We were told that if we kept receipts we would be reimbursed. All I have got back is a wall of silence !

    Doesn't matter
    Private Parking Tickets - Make sure you put your Subject Access Request in after 25th May 2018 - It's free & ask for everything, don't forget the DVLA :D

    The regulation says in Article 3 (3): "it shall apply to passengers
    having tickets issued under a frequent flyer programme or
    other commercial programme by an air carrier or tour
    operator."

    So I think you're good to go!

    Sounds really poor show
    According to the BA thread on here and a couple of colleagues experiences, BA have been pretty good at paying out - a friend had a cancelled flight and some expenses, and had cheque within 2 weeks
    You may be better having a read of the recent experiences on the BA thread and posting further on there. There is also an EU compensation thread over in the BA forum on FlyerTalk
  • I have finally received the following response from air Canada regarding a flight delayed for 18 hours from LHR to Montreal in august this year. I am wondering whether to go to the next step of contacting the CAA. Air Canada claim it was an extraordinary event leading to delay...I'm not so sure....what do u think?

    Dear Dr. Taylor,

    Thank you for your letter requesting compensation under the EC Regulation 261/2004. We sincerely apologize for the disruption to your travel plans. We know that customers want to get to where they are going and it is easy to understand this was a disappointing experience.

    We understand you are requesting compensation under Regulation (EC) No 261/2004 of the European Parliament and of the Council “EU Regulations”. However, we are of the opinion that the compensation requested does not apply in this situation. The circumstances were extraordinary which could not have been avoided even if all reasonable measure had been taken.

    Indeed, the aircraft intended to operate the flight was not available. The aircraft was originating in Montreal and prior to departure, a failure of a necessary aircraft system, specifically a hydraulic leak, became apparent prior to departure. An investigation and repair was required before the aircraft was airworthy and as such couldn't operate safely.

    Although Air Canada aircraft are maintained in accordance with the required maintenance program, this unexpected flight safety shortcoming was not something that could be foreseen and there was no choice but to delay this flight since it has no other aircraft available to operate it.

    We hope you will consider using the goodwill travel credit provided to you and fly with us again soon.

    Surely it is EC as the flight was from London. I amazed that air Canada did not have another plane in Montreal to complete the flight over to London. The hydraulics issue doesn't sound very "extraordinary"either
