    Was delayed by travelservice/smartwings in july 2013. complained and got the below. flight was delayed by 7 hours


    thank you for contacting the Customer CareDepartment. Based on your letter, we commenced a formal investigation of allcircumstances that led to the major delay of your flight QS2102 from Lanzaroteto Belfast on July 27, 2013.

    First of all, on behalf of Travel Service airlines, I would like to express ourdeepest apologies for all the inconvenience that occured. We assure you thatbeing one of the biggest charter airlines in Europe, the passenger´s safety andcomfort together with our on time performance are our highest priorities.However, same way as with any other airline, our operations may be affected byvarious factors that can cause irregularities, but are non-avoidable by theairlines at the same time.



    The flight QS2102 on July 27 was delayed dueto unexpectable technical failure of the aircraft that could not have beenavoided nor predicted by the carrier even if all performable measures had beentaken. Therefore, we are convinced that there is no right for financialcompensation. Please note that this standpoint also reflects the meeting ofNational Enforcement Bodies held on 12 April 2013.



    However, as we feel our undoubtable moralresponsibility for passengers´ satisfaction with our services and we understandyour disappointment caused by the situation, we would like to offer you afinancial compensation of 150 EUR per person. In order to receive thecompensation, you are kindly requested to send us the names of all passengersconcerned and also the following details about the bank account where thecompensation should be sent:

  • Going back to 2008, we were delayed 15 hours in Dalaman. I wrote to thomas cook at the time and they said the delay was due to technical problems. Now I read ........ 'Technical problems cannot constitute ‘extraordinary circumstances’ under Article 5(3) of Regulation No 261/2004' ............
    so should I claim again?

    Wrong thread - you should be posting (after you have read FAQ's on page one and the entire thread) on the Thomas Cook one.

    Oh, yes by the way ...... Article 5(3) has some bull regarding extraordinary circumstances.

    Have received defence from Travlaw who represent TC saying EC but not saying what it is etc as to be expected.

    They have also said that I can only claim for myself and not wife & child so if they loose will only pay out 400 euros instead of 1200 as I have asked for. Claim clearly states wife name & daughter name

    Had a read through a number of threads, now somewhat confused!!!!

    Do I just need to send some thing to someone saying say we are all together? If so, who

    Seems a bit stupid to me, if Travlaw want to stick to these tactics, if correct. Because when I win, don't think there is going to be any dispute over the remaining 800 euros

    I would include in your bundle a letter from your wife authorising you to prosecute the claim on her and your child's behalf.

    Of course, as you say, it's a slightly moot point. You might explain to the judge at the hearing that it would be a waste of the court's time to endure three separate actions, when you would hope that if the airline was found against it would obey the court's direction and compensate passengers accordingly without the need for further litigation.

    I've had this problem, so sent a letter to the court with form n235 in respect of each of my children. But yesterday i had a letter saying the judge has directed i fill in court form n244and pay 80 quid for the privilege of adding the other 3 claimants to my claim! Gutted! I rang the court and told them i only did what mcol advised and the sympathetic lady at the court said she would put it back before the judge and explain that. She could see my statement of case was clear that my claim included the 4 of us. She said it would be at the judges discretion whether he would impose the fee. So i await further direction. I will let you know how i get on!

    Me and my family recently returned from Turkey and were given a delay time of 2 and 3/4 hours but actually didn't take off in flight until after 3 hours. Could anybody help with information on this situation?

    Arrival time is the important factor so compare actual arrival with scheduled arrival and then if 3 hours + look at page one relevant to your airline.
  • Hello,

    I was just successful with Thomas Cook and it only took about 3 weeks.

    However they have offered a £686 voucher rather than a cheque (which has to be used within a year) Is this allowed, because I'd prefer the cash? I cant seem to find the answer to this.
