  • Just started the process of claiming after our 8 hour delay on 3/9/13,from Heraklion to Glasgow. Thomas Cook say it was due to extraordinary circumstances (technical problem) have contacted T/C via online form and had a response to say no compensation is due. If I want the information regarding the aircraft technical problem I have to go through CAA. Sent off my email today which they have received. I will let you know how I get on!!

    Agreed. They will refer you to the Greek NEB, who may write to the airline but will be ignored. TC know this, which is why they have sent you down this rabbit hole. NBA letter then court, is my advice.

    Firstly, apologies for going off on a bit of a tangent here, but I can't find what I'm looking for elsewhere on the site and this thread seems to be my best bet.

    It's a long story, but I was on a connecting flight on the weekend that was delayed on take-off because the runway was unexpectedly busy. It seems that private jets were using the main runway or something, so there was an unexpected delay of about 45 minutes. It meant that we missed our connecting flight. The airline booked us on to a flight with another airline 2 hours later, with no complaints (they would also have paid for our hotel costs if there was no space on the other airline's flight). This flight was also delayed by about 2 hours due to it arriving late. All told, we were delayed by approximately 4 hours. This was not an EU flight so I know I cannot claim compensation by law, but I'm trying to apply EU principles in my argument with the airline (they've recently been beaten up in the courts over compensation for bumped passengers).

    However, I'm not sure if I'm being unreasonable. Does the delay sound like it was controllable? The fact that the airline immediately put us on a flight with another airline makes me think that they consider it to be controllable. The manifest we were given to allow us to check in to the flight had "controllable" written on it, so presumably they think that it is, but wanted to check what others thought.

    Not really enough detail to be able to offer a view. But if a runway is too busy this is effectively an air traffic control issue outside the airline's responsibility, IMHO. You don't say what the second delay was caused by. Not sure how far you will get praying the spirit of the Regulation in aid: it's not really a global standard or anything.

    Hi there. Been searching around but can't quite find the answer to my question.

    I think I may be entitled, but hoping someone may be able to clarify - and if I AM, the best way to go about claiming...

    I purchased a package of flights through STA, all operated by American Airlines/British Airways.

    Last Monday at 1.30pm local time I was supposed to fly from Bogota to Miami with American Airlines, due to arrive at 6.30pm local time in order to then catch an American Airlines flight operated by British Airways (so basically the 2nd flight was a BA plane) to London.

    However, the plane taking us from Bogota to Miami was delayed by around 3 hours as, when it took off from Miami to come down to us, it was called back by someone from Miami airport due to a technical/maintenance concern. I'm not sure whether this is a AA or Miami airport issue.

    Since the flight from Bogota was late, I missed my connection at Miami back to London - which was the last AA flight to London that day - so AA put me up in a hotel and arranged for me to get on a British Airways flight the following day at 5pm ish.

    So I basically arrived home around 21 hours late.

    The flight where the issue lay was non-Eu to non-EU, but it meant I missed the connection back to London. As outlined, both flights were described on my ticket as American Airlines flights, although the second was actually a BA plane.

    Is there anything I can do?

    had the BA flight from Miami to UK been delayed and you arrived back over 3 hours late then you would have had a claim.
    As the affected flight was non-EU airline departing from outside the EU then there is no claim.
    You could see what your travel insurance offers for this
  • I've been writing to BA since my flight was cancelled (due to lack of BA staff) in mid July. I only get automated responses from their "Customer Services" asking me to be patient!
    At the time, I was told by BA staff that if I kept out of pocket receipts I would be reimbursed. Well, the cancellation resulted in an overnight hotel, taxis to a different airport, meals etc. I am considerably out of pocket. How can I get some action out of BA. I've written to the CEO and he....forwarded my email to Customer Services who sent another automated response !

    Advice please !

    Who booked you on the alternative flight from a different airport? was this also a BA flight
    If BA had arranged the alternative flight then they would normally have sorted out these costs
    If you booked alternative flights independently then you will have more of a challenge as you have removed yourself from their care
  • Before I send my claim forms to Virgin.....does it make a difference that I paid for part of the holiday with Tesco vouchers?
