My wife and I were booked on 18.30 hrs flight from Berlin Schoenefeld to Gatwick on 23rd July. One hour 15 mins before take off I received text from EasyJet stating flight was delayed due to having to swap to another aircraft. At 19.17 hrs further text stating flight delayed due to crew exceeding flight hours. Eventually took off at 02.35 following morning and arrived Gatwick approx 8 hrs late. Compensation claim sent to Easyjet quoting EU regs but fobbed off with extraordinary circumstances.
In view if their own text messages stating reasons and even after second text stating flight crew ran out if hrs we were still over 5 hrs late. Are EasyJet just ignoring the law and do you think this would be very strong case for a small claims court tidal with? EasyJet reply says Incan check reason for delay via CAA but their texts already tells me reason for delay.

My son his wife and their 2 little girls were due to fly from Gatwick to palma Mallorca on 27/07/13 @13.30 their flight didn't take off until about 18.10 even though they boarded at 17.00. they were not offered any refreshments or vouchers for refreshments. they were told there was rust on the wing that caused the delay. do they have a case for compensation please.0

Sounds like it but you have failed to mention the airline. Look at page one of the thread (FAQ's) for that airline then post later in the thread if you need to.0 -

Post on EasyJet thread if necessary. FAQ's on page one are your friend. You have a strong case so forget CAA and issue 14 day NBA.0 -

I would say yes, as rust does not appear suddenly. This would be due to poor maintenance0 -
Have been told it doesn't usually happen, and you can only do it on legal grounds
Is this legal enough
Despite being informed by the National Enforcement Body appointed by the Spanish government that they should pay my party 400 Euros each in compensation, they refused and have continued to refuse.
By blaming the delay on the action of a third party they are in fact admitting liability under paragraph 80 of the legal challenge to the Sturgeon judgment of 23/10/2012

We flew to Zante in June from Manchester with Thomson. After we all boarded we were advised that ground crew had left the crate holding the electrics too close to the 'plane and due to the increasing weight as we got on board the plane had rested on the crate and there was a dent in the front wheel flap! The result was an 8 hour delay and a loss of our first day in the resort. After the initial explanation from the captain there was no further communication. We were not offered any vouchers for lunch nor kept updated. In fact our flight even disappeared off the board for a couple of hours.
Do you think it worthwhile trying to claim? I expect Thomson would say it wasnt their fault but I am sure they will be getting adequate compensation from Manchester Airport for the event0
